        I joined a job month back and resigned few days back .Company has 3 months notice period and I am serving currently. Manager is giving more work and targets which he knows I won’t be able to complete purposefully and threatening me that he will give termination letter and will extend my notice period until I complete for underperforming.
        Can the company give termination for underperforming for short tenure( as I worked only for a month and resigned)
        I have given health issues as reason
        What should I do
        Please help.

          What kind of company is this? Legally no one can extend your notice period without your approval. And for all the other shenanigans, labour court highly favours employees.

              I dont even want them to pay.
              They are threatening they will give termination letter by stating I am underperforming during notice period.
              Can they terminate for underperforming ? As I have worked there for a month only.

                  They can terminate for any reason. That is their right. However giving a clean experience letter is their obligation unless criminal mischief is involved. Else labour court would love to screw to them over.

                  Do you really need that experience letter for 3-4 months?

                      I don’t need
                      But I’m epfo portal company is visible
                      So in next company if they ask
                      I need to submit relevent documents
                      That’s is why

                      Have you pissed your employer or demonstrated not so ideal behaviour?

                      No one will waste their time on less than 1 month old in organisation employee.

                      Do you have real health issue preventing you from continuing? Or using that as an excuse to exit? If later, may be your manager has figured this out and looking to make your life difficult.

                          No,I have not
                          Actually work culture is not good,there is toxic environment ,asst manager whom I am reporting is not giving me any guidance and she uses abusive language .
                          And I am really having issues with migraines
                          Not able to work.

                      Just stop working and extend eta and see what happens. If they do this then hire a lawyer and sue them. Before doing all this check with your new employer if they are ok if you get experience or reliving letter a bit late. Else you may lose your new job in all this nonsense
