February 10, 2025 at 5:05 pmMy sister got married in 2022 in India following all the Hindu rituals but they didnβt register their marriage in India and registered only in US once they got back. Now her husband has sent a divorce notice in California. Can the divorce case be filled in India given itβs registered in US only but we have wedding picture with us as proof? Thanks for any guidance on this. -

If yes, then the marriage is valid under hindu marriage act.

February 10, 2025 at 5:24 pmDepends. If they girl is in India she can send a divorce notice to him. If she also is in US then doesnt make sense to file case here. But if she wants to get married in india she has to get divorce here or the new marriage becomes void

February 10, 2025 at 6:10 pmLawyer here:YES. Divorce can be filed in India in the same district where the marriage took place.
Among other Jurisdictions, the Hindu Marriage Act, 1955 [Section 19(i)] gives Jurisdiction to the Court where the Marriage was solemnised.Feel free to raise any further query.
