If you are divorced in US, you are divorced in India too.
Remember that if the spouse is in dependent visa, the moment the divorce decree is signed by the judge, the visa is invalid and the person is staying illegally in US.

April 2, 2025 at 1:48 pmNothing stops you from filing for divorce in USA, but a foreign divorce maintainability in India is complex and I would advice you not to go through a divorce in USA. It’s better if you initiate the process in India preferably on mutual consent basis. Please consult an Indian Lawyer before taking any decision on this front. -

April 2, 2025 at 5:31 pmIf it is a mutual or a contested divorce, then it will work. There needs to be a verbiage in the divorce papers that your lawyer can take care of. Once itβs done, just to be on safe side, you can file a mutual divorce in India too. Your lawyer in India should be able to help with this.If it is a unilateral one way divorce, India will not recognize the divorce.
