March 8, 2025 at 4:27 amI come from a middle-class family and am the second eldest of six brothers and one sister. My mother is still alive, and we practice Islam. My father owned approximately 24 bigha of land. Sadly, he passed away last year, and I attended his funeral after being away for 20 years. I had limited interaction with my family during this time. Recently, I discovered that my youngest brother took a KCC loan without informing anyone, and the land is in my mother’s name. I’m unsure how to proceed. Please help. -

March 8, 2025 at 6:02 amThe government should make a law to prohibit the likes of you to inherit any share of property because you haven’t been at home and haven’t performed any duties of being a son to your parents but you come as a leech to demand your share of property after the death of your father.
If you’ve any iota of self respect, you would have given your share to the brother/sister who took care of your parents.-

You cannot seek any shares till your mother is alive. -

March 8, 2025 at 5:04 amSomething is not adding up. Loan for ancestral land would need to be guaranteed to by all inheritors especially for people practising Islam as everyone has equal rights. Your brother has probably done some fraud -

March 8, 2025 at 7:00 amI’d like to clarify that I’m not the one requesting a share. I’ve attempted to contact my mother multiple times, but she hasn’t returned my calls. Upon my return for the funeral, she pretended to be ill. Additionally, one of my younger brothers has asked me to handle this situation as none of my other siblings want to be on bad terms with the brother who took out the loan. -

March 8, 2025 at 9:27 amKCC can be taken without collateral also upto 2 lakh. If it’s a higher amount and the land is in your mother’s name he can’t use it as a collateral unless she enters into an agreement with him . I don’t think there is anything you can do if this is the case -
