UMy cousin brother met with an accident few months back where he fractured a vertebrae went under operation and has been on bed rest . He owns a business and can work from home . After he met with accident his wife insisted to take him to another city for treatment where she introduced her lover as her family and childhood friend and help them navigate in the city. Later after the treatment was over the guy befriended my cousin and started visiting them and Later on she got caught on date by my other cousin . Where she churned it into us being close minded and claimed it be a false allegation then went to live with her parents even dropping her two sons with my cousin who was on bed rest himself. While she abandoned her kids and husband we saw her often with that guy in clubs and cafes. later my cousin went to her parents and apologized and said he would like to work on thier marrige for the sake of his two sons who are both under 10 . She asked to put the house under her name as condition to come back and transfer some shares what my cousin was holding under her name after all that was done . Few days back she ran away at night with the guy abandoning her children and my brother with money and jewels . when we went to police station to register a fir the cop told us an fir has been already registered against us by the girls family . On further enquiry she already has slapped dowry and domestic violence case against whole family while she is missing herself and her family insists that it is us who has been behind her missing and causing a commotion. How do we navigate from here as my vacation is almost over and I have to go back to Europe would my name in the chargesheet cause any problem for me to return ?

BMy dad’s ex employee who along with his brother are still close to our family got slapped with a dowry case last week just after a week his grandfather died. His wife had left him years ago just within a couple of months . His entire family was named in the case including the wife of the younger brother who she had never even met because she had already left before his marriage.
Women who misuse the laws that are meant to protect them are one of the worst kinds of women in the society the worst being the abusive and murderer women

UAdvocate here. Although I have never done these cases. But for those who do, this has become very lucrative business for many lawyers, and they are exploiting it to the fullest. Since they get the fees as percentage of settlement amount…..so they slap as many fake cases on the husband and his family. It has become a template now. The number of these DV cases listed before each court daily are very high…..90% are fake. Cops and lawyers both know it. Judges must know it too. Daily they wait in the courtroom…….petitioner….One look at them (the wife and her relatives) and u know it’s fake..they almost have a smirk on their faces..these guys are just waiting for when husbands family gets tired of the harrasment and gives them settlement amount. Sometimes the wife the home on the next day of marriage and filed case for a ridiculous amount like 70L-80L. Disgusting. Women who are the actual victims….. They shall suffer because of these greedy people.

PNo good deed goes unpunished. India will soon have to remove these laws bcz of misuse. Then people will cry wolf and advocates will wonder about good ol’ days when they could get easy money. I wish hell was real.

UYes , atleast 30% of lawyers will shut shop when this piece of legislation is gone. Although I don’t see it going away ……. atleast for the near future. There’s no political lobbying from “Divorced middle class men and their parents” who have suffered from its misuse. Which is weird isn’t it? A majority of taxes and votes are from them yet no party seems to care. If some unjust law were to be passed affecting companies from any specific sector…….it would have been quashed within 1 instance of its misuse. And here we have thousands of instances each year ……. men tired from years of systematic harrasment cancelling themselves , whole careers destroyed, life savings of their parents gone into settlement amount yet no one seems to care.

PThis is a problem from the side of the judge. Why grant that huge of a settlement.. Whenever there’s any case (unrelated to marriage), of course lawyers will do their best to make their side the strongest. It is the duty of the judiciary, esp judge to decide what is right or wrong.
Removing the laws would also not be ideal bcz we cannot shut our eyes to the actual, obvious and blatant DV happening around us.

I1. Run away from india asap, before they bar you from it.
2. It’s actually good for you all. In cases like these where the wife blames every random family member, makes vague allegations and no specific incidents are given, FIR can be quashed by the High court. Especially for those who don’t even live in the house where the wife lived.
3. Don’t let her come back into the house or she will claim residence orders from court and the husband’s family can be made to leave the house when she says they are still torturing her.
4. When names get dropped from FIRs as per point 2. Urge those people to file defamation, mental harassment and other counter cases on the wife and her family. This will create pressure on the wife to settle the matter outside court or face consequences for the same.
5. Outcomes of these steps will help show the courts that the wife is just making stuff to create problems for the husband. Proof of her affair will help in this too.

FI have even seen women lodging DV case against relatives who don’t even live in the same state or country for that matter. How can this be allowed? It seems nobody is immune to this pathetic law. Worst thing is the accused then have to go through the trouble of hiring a good lawyer and spend sleepless nights and money to get the FIR quashed. What a fucking joke this country has become.

SAdvocate here, my advice would be to hire a damn good lawyer(money shouldn’t matter).
If she filed for divorce under the pretext of cruelty then file a reply and state everything (even the smallest details) to your advocate.
Gather all the evidence you have, get everything on the guy she ran away with, make events date by date.
As she ran away with your money and jewellery file an FIR against her and that man.
Coming to the custody of your kids I believe she won’t contest it as she already ran away but it is at judge’s discretion.
If 498A is filed make sure you prepare your witness(s) could be anyone & documentation proofs as exhibits.
As to your name in Chargesheet it’ll definitely cause a problem as you’ll be required to come on every hearing unless permanent exemption is granted or simply ask your advocate to file an “application to remove party” citing clear reasons as to why you shouldn’t be a party in this matter.

SSince the house and share was transferred in the wife’s name, its likely the judge will see through the facade. And dismiss the case.
As for OP, i think the best choice would be to hire an excellent lawyer ( discuss strategy first and make sure you’re onboard ) then get the heck out of India. If you delay it, there are high chances you’ll be stuck here.

UIn these cases, Judges are NOT unpredictable. 95% of the time they favour the wife almost as a rule. Came across this “lady” who had married and divorced 4 times (each marriage lasting about a couple of months). Filed cases on all of husbands and successfully got a good settlement amount from all of them. I mean….. WTF.

Your cousins sounds like a complete moron. His wife cheats on him, so he then puts her name on the home and business shares?
Cut your losses and go back to Europe. People like your cousin will always chase after the girl no matter what and ruin his life.

Umaybe he genuinely loves his wife. In such scenario’s things do get blurry. Here she seems really vile. And looks cases were blind sided.
In my case my ex openly threatened me with all the sections to Harass me and my family. We visited lawyers to understand what to do if she files cases against everyone in the family. She wanted to use our WhatsApp chats as some proof etc. I have no clue what she found incriminating in them
