        As the title says, my dad got charged with a corruption case falsely 2 years ago. He used to work in a government department. On 19th February 2025, court convicted him. Now he’s under police custody. He got charged on October 21, 2022. His retirement was 10 days later that is October 31, 2022. All the retirement benefits have been stopped including superannuation money and pension benefits. We have appealed to high court. How much time it takes for bail in high court ? Will the retirement benefits be stopped forever ? Is there any way to claim it ? He got trapped for something he never did. I don’t know what to do and lost all hope.

              I don’t know how much this will help but still it might help you out in later stage –

              My Fufaji works in Commercial Taxes Department and 6 years into his service he was trapped in a case of 800 Rs bribe. For 15 years he fought this case and it was just recently that he was acquitted and reinstated but certain benefits have been denied to him because it’s on the discretion of the Department head to give NOC for those benefits. For the first five years he relied totally on his lawyer. But that mofo fucked up the case. It was only after he realised how much the situation got fucked up for him that he stopped relying on his lawyers. Afterwards what helped him was this – He READ EACH AND EVERY LAW PERTAINING TO THIS MATTER and on top of this he went through almost every SC and High court judgements that have been given in cases similar to his. Idk why but judge who was overseeing this case was seriously impressed with my uncle’s legal knowledge.

              Point I’m trying to make here is – Read and get informed about anything & everything related to your father’s case. But the fucking books if you have to and read them. Let your lawyer know that you know what’s happening. Don’t let lawyer keep you in dark or fuck up your situation.

              Other than that just be strong. It’s gonna be very long fight brother.

                It’s not uncommon for the good ones to be punished/trapped this way. Path forward : settle with the corrupt ones who fixed him, appeal in high court and get acquitted. No fault of his but dragging these things forever is one path or the other is the first few sentences I wrote. I’d recommend being pragmatic and make choices to get out of this jam in a reasonable time and inexpensively.

                  There will be no retirement benefits if you are let go under the charges of corruption. If you have a good lawyer, you may be able to build a narrative because he was charged 10 days before his retirement. Unfortunately, such cases these go on for 10-20 years before it comes to a conclusion. It might be easier to focus on getting a bail.

                            2 days ago, MLA of that area called him in this matter and abused him way too much. Another Minister called him for this too. I have these call recordings. I can feel the pressure he had for passing those bills. He was already under pressure to pass those bills. The matter was even directed to CM. People were protesting against him for passing bills. Why would he demand bribe for this ?

                            Also bills couldn’t be passed earlier coz complainant paperwork was incomplete.

                                  This is direct violation of past SC judgements where the court held that pension can only be witheld after conviction. Corruption proceedings in court do not amount to become grounds of holding pension.

                                  You should directly file a writ in HC seeking urgent relief. Contact a good lawyer.

                                    As someone who extensively practices at Bombay high court, I can tell you that your counsel must have file an application for suspension of sentence along with the appeal before the high court. Depending upon the prima facie evidence and conviction of the accused, the interim protection in suspension application is usually granted on the day it gets listed before the court. That said, appeal and confirmation of suspension would take its own time.

                                            Time for what? If it’s the interim protection, that should be done at the first hearing itself if any case is made out.

                                            As for the appeal, that really depends on the work load of the court and if any urgency is made out by the counsel.

                                                Corruption was one of the primary reasons my dad didn’t join the government sector despite getting selected and stuck to his private sector job .

                                                One of my late relatives who was gov officer was implicated in a false after his retirement . He was a celebrated officer.The vigilance team raided his home although they couldn’t convict him ,the sheer shock and trauma that he was falsely implicated took his life .

                                                If you want to enjoy corruption then join gov services .

                                                  Sorry to ask but I just want to ask that your father being put into a false case has caused what type of problems in your life or social life? Are you married or not? Does a person whose parents involved in a false case or a criminal case have problem with their children to get married especially arranged marriages?

                                                  My father is also implicated in a false corruption case by his company employees. Is there any problem for me to get married if father has a false corruption charge against him?

                                                      Personally it destroyed me mentally. I (21F) am doing Btech and currently in 4th year. This all started in 2nd year. I can’t explain my absence in college to my friends or authorities. I have two sisters and one brother who is minor. We all aren’t yet married, all studying. Only my dad was the sole bread earner of this family. Socially, it damaged our reputation in society. We haven’t thought bout marriage or anything as of now.

                                                            My father is also implicated and scapegoated by his colleagues in a case of corruption related to a project he hasn’t worked upon. His name is in the fir at near the top on the project he hasn’t been part of. I’m concerned about my marriage as he’s been always being in trouble all his life due to his innocent and coward nature all his life he’s been always being stuck in some matter
