        Back in April 2021, during the second wave of COVID-19, my maternal grandfather (nana) passed away under unclear circumstances. Just ten days later, my grandmother (nani) also passed away. They had four children — three daughters and one son.

        After his passing,the son (my maternal uncle) locked the house, citing COVID-19 protocols, and strictly prohibited the sisters from entering the premises, claiming it was for health safety. During this period, they destroyed all original documents and potential original will, keeping the sisters completely in the dark, after 5 months on September 2021 all 3 sisters got to know that a will is registered in sohna tahsil, & all the nana’s property, cars, house, FD is going to brother & his kids name & the witness on the will are their driver & servant.

        After some inquiry, we found out they bribed the tehsildar and got the will registered fraudulently. So the sisters challenged it in Sohna court. Now, after 4 years, nothing happened on the case, the lawyer barely shows up, doesn’t argue the case properly, doesn’t answer what’s been happening on the case and now he’s asking for 25% of the will’s share just to keep representing them. The lawyer never filed for a stay on the property. Meanwhile, the son’s children continue to collect rent from the property and are allegedly bribing anyone who gets in their way.

        Due to the immense stress and ongoing harassment by the son’s children, one of the sisters developed paranoid schizophrenia, officially diagnosed by the Department of Psychiatry at AIIMS Delhi in April 2023.

        To make matters worse, one of the son’s children has now received a Congress party ticket for the Delhi Assembly elections, and is reportedly influencing the ongoing legal process and the lawyer involved.

        Why the Will Appears to Be Fraudulent:

        * My grandfather had been living separately from his son for the past 35 years. During this entire time, they had no communication.
        * Servants had been preparing food and taking care of both my grandparents for the last 35 years.
        * The son has been handicapped for the past 25 years and uses only one leg. My grandfather never arranged an artificial limb for him, It is highly suspicious that he would suddenly decide to leave everything to him.
        * The will includes cars in the son’s name, even though he has not driven in 25 years due to his disability.
        * Throughout his life, my grandfather never named any property or vehicle under his son or grandchildren’s names. It is highly questionable that he would choose to do so only after his death.

        This whole thing is dirty. It’s emotional, mental, and financial abuse — and now even political. We feel helpless. No one’s listening. The court is slow, the lawyer is corrupt, and one of the key victims is mentally ill from the trauma. I don’t know what to do anymore.

        If anyone has advice, has been through something similar, or knows someone who can help — please help.

          Property disputes are time taking, be it inside court or outside.
          1. File a criminal case of fraudulently and dishonesty producing a will, and getting it registered. You may or may not name the tehsildar as accomplice. But you should name the driver and servant as accomplice, along with your mama and his sons as main culprits. If the police doesn’t file the FIR, approach the court and get it registered under section 175 of BNSS.
          2. The allegedly forged will must have been produced by forging your Nana’s signatures. Demand for an FSL test done on the authenticity of the signatures. This you can do in Sohna court, as well as in the criminal case that you file. For this, gather documents of your Nana’s signatures of recent past. That will help in proving your case.
          3. Find a better lawyer. Judicial system is a message, and unethical lawyers (who forget the first principle of keeping their loyalty to their clients) make it worse. Yes, pay will be higher, but it is needed for higher rewards.
          4. If you can, prove it on record that your Mama never took care of your Nana.
          5. If your Nana’s property is ancestral (which means it is inherited to him from his father or even beyond), then your mother and her sisters can file a joint claim to their share of the property anyway. This you can do via a separate case in a court where its jurisdiction is.

          6. Most importantly – if Mama ka beta is congress candidate, then you have BJP ka MLA who won. Approach him, find a contact, go to his morning jansunvaayi, and tell him your grievances. He will get you a way into police. But still, be ready for some under the table demands at various steps. If the SHO still doesn’t help, approach ACP/DCP of your area.

          That’s all I can think of. Lawyer up, and be ready for all this, including (may be) death threats from your mama’s side.

              The thing is they have political connections so police won’t file FIR also 3 sisters doesn’t have money to give bribe & the other party keeps getting rent from the properties lacks of rupees & bribing everyone who comes on the way

                  If that Will is officially registered then it’s going to be a tough fight. Mostly won’t be able to win it.

                      The most important fact is that the will is registered. What is the date on the will and on what date was it registered ?

                      What do the witnesses to the will have to say ?

                      I am assuming all the assets willed were self-acquired. If that is not the case, all legal heirs have equal share in assets that your grandparents inherited.

                          This whole situation stinks from top to bottom.                           The current lawyer is clearly in on the game, asking for a 25% cut? Absolute scam. Fire him.                           At the end of the day, this is about fighting back against a corrupt system. They want to wear you down, but you need to keep pushing. **Be loud, be persistent, and get the right allies**. If you have enough support, the political connections won’t matter as much.

                          And lastly, take care of your mom and masi. This kind of mental and emotional abuse can take a serious toll. Keep them safe and look after their health first. The rest, we’ll fight out.
