        I’ve been working at a company for more than 6 months now. I like my work, but the management is not good so I’m looking for better options. Also, we were promised 9LPA, i.e. 75k per month, according to the offer letter. But after tax deduction, PF and all, I get 64k in hand. I don’t have a single casual leave. If I take a leave, around 2.4k is cut for one day. Adding to that, my team was asked to work on Sundays, but we refused.

        I’ve been asking my employer for salary slip for more than 4 months now, and he’s been avoiding the conversation. I logged into in income tax portal to see if the taxes have been paid and it shows that no tax has been paid so far. I asked my employer about this and got no response. Maybe he’ll pay the tax at the end of the financial year.

        This is my first job so I don’t know how all this works. I have a feeling that the company may be evading taxes. How can I confront my employer about this? I’m afraid I’ll be fired if I confront him strongly. What should I do about this? Thanks in advance for all the helpful advise ๐Ÿ™

          Whaat? Do you work in a sweat shop?

          How on earth is he not providing a payslip? And no casual leave is so wrong. What about Privilege/Paid leave?

              I work as a teacher. So I only get one week off in the month of May.

                  I worked with a early stage startup, same issue ,they are not giving me salary slip, other recruiters are asking me, I don’t know how to deal with this.

                      You should not be working in such places to begin with. They can technically fire you any moment without any possibility of repercussions.

                        Just a question what do you mean by not giving ?

                        Did you ask them for payslip? Or you didn’t ask and it’s not shared on monthly basis?.

                        Just write a mail to the team who handles payroll and say you need payslips for bank related work.

                            I’ve asked him, so many times. I need the pay slip to apply for a loan at the bank. I’ve asked him so much that he’s probably very annoyed by me. This is a small company, so we don’t have email IDs. There’s this one person who handles all the accounts. That’s all.

                            First check if they are actually deducting your salary through PF account or not. If they are registered entity under PF, they should provide salary slip as well. It’s very important document along with UAN for your future employment.

                                They are deducting PF, but I’m not sure if they are deducting it through PF account.

                                    Ask them to provide UAN no and than login to EPFO website through that and check the passbook if PF is getting deposited in that or not.

                                  Please work with a CA to identify if the company is registered to begin with. If it is registered, what’s the type of registration and the headcount.

                                  A company with more than 20 employees is liable to submit TDS as applicable and PF for all employees.

                                  If the company has more than 20 employees and you have a way to prove it (any form of employee attendance, etc.) you can also file a complaint with the Ministry of Corporate Affairs and the Ministry of Labour and Employment.

                                  If there are more people like you, all of you should look into filing complaints with the Income Tax department and EPFO.

                                  I hope you got the payments via bank account. You would need to present evidence of credit for salary.

                                  The above information is assuming you’re a full time worker with the company (as per your offer letter) and not a contract worker.

                                  But be prepared for a scenario where the company may just tag you as a contractor. A company is not liable to deduct/submit TDS nor PF. So while in theory your gross pay is 75K, in reality you’ll end up with your in-hand salary as your actual salary and you’ll be liable to pay taxes from that amount.

                                    You must get your UAN number for PF and this is a clear sign of Lala company. I hope you get salary by cheque and not in cash. Whatever the case may be you can show bank balance as a proof of income to next employer.

                                        I have a UAN number and the salary is credited to my account.
                                        But will the bank statements be enough, wouldn’t a new employer ask for the pay slips?

                                            Check your PF passbook which shows company name and amount of PF credited in it every month.

                                            PF number gives your entire service record.

                                            If you still wish to make a salary slip then use Zoho salary slip creator and get it signed and stamped by your employer.

                                              Yeah, but if I need to apply for a home loan or car loan, wouldn’t the lay slip be needed?

                                              Ask your employer to either provide a salary slip or pay your gross compensation in full.

                                              You potentially work with an employer with very poor compliance with Indian labor laws.
