        This is my friend’s story. She got married at just 16. Her mother died when she was born and she was raised by her nani. Later she was married to a drunk man who used to beat her regularly. Still, she stayed in the marriage for 7 years hoping things would improve.

        One day she found out her husband had mortgaged all her jewelry, the jewelry her nani had made for her with love. The amount later became around 5 lakhs. After that she left her sasural and raised her son alone for 5 years without any support.

        She worked small jobs with a salary of around 9k and somehow tried to manage the jewelry recovery amount, her son’s studies, daily expenses, and her own survival together. I even helped her get a small job so she could survive independently.

        But with such a low salary, she wasn’t able to handle the 5 lakh recovery amount, take care of her son’s education, and manage her own life all at once. So she later left her son with her in-laws so at least he could study properly.

        Now they are not even allowing her to talk to her own child.

        She wants to take legal action but she is scared of courts, police, and long cases because she is already struggling just to survive.

        She only wants to talk to her son. I genuinely don’t know what advice to give her anymore.

          Tell them to approach local police station and file an application. The cops will call her in laws after dragging the matter for a few days. This is the first step.

              We already contacted the SHO. He initially called her mother-in-law and said he would visit the house, but after that whenever we followed up, he kept saying he was busy and would call later. Nothing has happened yet.

                  You have to go and sit there. Then send a registered post to the dho and do the same to the police dsp and then approach the district magistrate

                      She also wants to take legal action, but she is already in debt and has no savings. If she leaves everything and starts fighting cases, how will she survive, what will she eat, and where will she stay?

                          The remedy you are looking for, police won’t be able to give you, more or less, they might be bribed, initiate a legal notice first, thereby seeking visitation rights to your friend to meet her son, followed by filing a case for custody and divorce both in family court

                              Another factor why police won’t entertain you is because your friend has been separated from her husband for more than 5 years, so cause of actiok to file a criminal case has been barred

                                  Actually, she had already filed for divorce earlier. The court asked them to stay together for 6 months before making a final decision. She went back and stayed with him for around 4 months, but during that time he again started beating her, even in front of their son. Because of that she left again before completing 6 months. The divorce case is still pending in court.

                                      Ask her to file an urgent application seeking custody of child alongwith monthly maintenance to her

                                          Exactly that is why i mentioned to refile custody application in that pending divorce matter alongwith an application seeking monthly maintenance to the child and your friend both

                                              Yes for that she need money we don’t have right now because advocate asked 20k that’s why we are looking for another option she just want to talk her son

                                                  Dude, every court in India has legal aid services, ask her to approach legal aid service! In which is the case pending?

                                        If the child is willing to stay with her she can file custody of child and ask for maintenance separately for child.

                                            He is drinker he won’t give maintenance every month she is waiting for govt job or any good stable job then she’ll apply for now she just want to talk her son nothing else

                                                She can send a legal notice for visitation rights, first seek the help of legal aid in your district they will guide your friend with further process.

                                              The mother can file petition for visitation rights and the court can direct police to arrange the meet on a neutral ground if the child is a minor Or the mother can approach the commissioner of police and request him to 8nterwine as the who is not helping
