UMy maternal grandfather passed away during covid and he had a home.My grandmother is still alive. My uncle(mother’s brother) sold the property and we were not given any money. When I asked my mother she said we will not be given any money because I am his daughter not a son.
Basically my grand father has 3 kids. My aunt,my mother and my uncle. We’re Muslims. Am I entitled Any money from the property?
How would I know this?

Iancestral property is divided equally in boy and girl. so if your maternal uncle is not ready to give your mother’s share then you can go to court against the brother, stil it is better that you take a lawyer advice on this. also hire him on fixed price basis and for consultation. (better to ask for his fees beforehand)

UU don’t know the rules it seems. I myself have experienced this matter ! My mother got her share of her grandfather’s property when my grandfather was not ready to give the share to my mom!
You can easily win this case but it takes 2 to 3 years for that.
Also I am not arguing, I just told my experience

PI know the rules pretty much alright (not a legal authority though) as I undergoing succession of various properties and assets (ancestral plus self acquires by parents both).
So it’s your MOTHER who got HER share!
That’s what I am saying too.In the case above, Till the OPs MOTHER is alive it’s HER share in her Father’s/ancestral property. The OP gets the share in his/her “Mothers” Property after she passes it on to her wilfully or on her demise.

Sproblem is like your mother was given gold or se cash at the time of marriage….
ou are asking for your share, but your aunt or mother don’t live with maternal parents neither feed them…
our society is crook…
your uncle should give like 50 , % share to aunt and mother like 25 % each. .
Even in property court will decide on value derived from papers ( white money) , if court asses market value then income tax authority will know on your door to tax black money part of sale value.
Court will take 30 to 50 years of time i guess.
Lawyer can guide as you say muslim family
..
But it’s the mistake of our society…

U1. You have absolute right over the ancestral property and your uncle shouldn’t have sold it without your consent/permission.
2. Both men and women have equal and absolute right over the ancestral property.
3. File a suit for cancellation of sale deed (the document through which your uncle sold the property to the third party) and suit for partition making your uncle and the buyer of the ancestral home as parties. Consult a good lawyer asap.

UAccording Islamic laws ancestral properties are pass through. Your mother or uncle don’t have the right to sell there ancestral property if next generation are already born.
