        My grandmother sold my dad’s property My grandmother sold my dad’s property what happen that my dad is a property dealer so he bought a house he named the house on my grandmother’s name but my grandmother sold the house without my dad’s consent we named her our house on the basis of trust but she sold it without my dad’s consent is there any way to get back the property we bought.
        Thanks for reading any suggestions pls

            She’s owns the property so she can sell it as per her wish. It’s not ancestral property.

                    Mentally unstable doesn’t prove that she can’t take decisions. Legal and mental insanity are both different things.

                    If she knew the consequences while selling the property then no mental illness can stop her from selling it.

                            But you’ll have to prove she was of unsound mind while selling the property and was mentally incapable of selling the property. That’s difficult to prove.

                                If the property is paid for by you dad, he still is its ostensible owner. This is subject to proper documentation though.

                                            NAL. If your dad can prove that he paid for the house, then he may have a chance at contesting the sale in court.

                                            I’d contact a lawyer if i were you.

                                                  Need more context like – What did she do with the money?

                                                  Options –

                                                  1. You can challenge the sale citing that she was mentally incompetent.
                                                  2. Drag it to court – Challenge that she had no source of income& your father purchased the property with his money ( better have proof for this)
                                                  3. If the above 2 are not feasible, take the hit & move on! Cut off all contact with her.

                                                      Why should the court interfere? He could have registered the same in joint ownership. Here he basically gifted her the property and she’s free to do whatever she wants to do with it.

                                                          In India, the process is the punishment. The moment a property is tied up in litigation, it’s value crashes!
