February 20, 2025 at 6:44 pmMentally unstable doesn’t prove that she can’t take decisions. Legal and mental insanity are both different things. If she knew the consequences while selling the property then no mental illness can stop her from selling it.

February 24, 2025 at 4:32 pmBut you’ll have to prove she was of unsound mind while selling the property and was mentally incapable of selling the property. That’s difficult to prove.

February 20, 2025 at 6:09 pmIf the property is paid for by you dad, he still is its ostensible owner. This is subject to proper documentation though.-

February 21, 2025 at 11:12 amNeed more context like – What did she do with the money?Options –
1. You can challenge the sale citing that she was mentally incompetent.
2. Drag it to court – Challenge that she had no source of income& your father purchased the property with his money ( better have proof for this)
3. If the above 2 are not feasible, take the hit & move on! Cut off all contact with her.-

February 21, 2025 at 11:42 pmWhy should the court interfere? He could have registered the same in joint ownership. Here he basically gifted her the property and she’s free to do whatever she wants to do with it.-

In India, the process is the punishment. The moment a property is tied up in litigation, it’s value crashes!
