February 5, 2025 at 8:42 amI vacated my flat on october 31 and handed over the keys the same day. The rental agreement is between me and the owner of the flat but i have not even met the owner because everything is handled by the builder (Which is a company)They are just delaying my refund of my deposit (45000 rs) Its already 2 months and they dont pick up my call or respond to my emails.
I raised a complaint in consumer [https://consumerhelpline.gov.in/](https://consumerhelpline.gov.in/) but i dont think this will do any good as the portal didnt ask for any commuication details.
What can i do to get my deposit back???

February 5, 2025 at 8:50 amSend a legal notice to the owner. From next time donβt handover the keys/possession unless you have the deposit cheque handed in return.-

February 5, 2025 at 10:53 amWe handover the key, they check for damages then deposit the amount. Thats how its usually done in my experience-

February 5, 2025 at 10:19 amLawyer here.Send a legal notice to the landlord and to the builder demanding them to pay back the deposit amount. If they don’t pay you even after receipt of the notice, you will have to approach the Court to get the amount. You can claim it along with interest and costs incurred.
You cannot raise a complaint in the consumer helpline portal since this is not a consumer dispute. You have not purchased any goods or availed any service from anyone. Therefore you are not a consumer.
You cannot also go to the police station and file a complaint. Police will not intervene in this issue since it is a civil dispute. They will ask you to go to Court.

February 5, 2025 at 10:50 amCan i add the cost i incur for senting legal notice?? It doesn’t make sense for me to pay it when i am not at fault. Also should i sent the legal notice to the owner who i have an agreement with or to the builder. Or should i sent it to both parties?? There is no mention of the builder in the agreement at all.-

February 5, 2025 at 11:02 amYes you can add the cost insurred for sending legal notice, including the advocate fee. They may or may not pay it. There’s no harm in sending the legal notice to both persons.
