        My mother is being harassed by an independent contractor who worked under her firm and now appears to be trying to extort money from her, and I need legal advice regarding what steps we can take in India. My mother received a contract through her own business leads. This person, who was operating as an independent/open contractor, asked to work under her firm because our firm was registered, and my mother agreed. The project lasted for three months with a total profit of approximately โ‚น4 lakhs. Since my mother secured the contract, managed the work, and handled the business, she kept โ‚น2.5 lakhs while he received โ‚น1.5 lakhs. At the time, there was no dispute and the matter was considered settled. However, around 6โ€“7 months later, after relevant call recordings and evidence had already been deleted due to the passage of time, he filed an FIR falsely claiming that my mother had not paid him his share and demanded โ‚น2.5 lakhs. We had recordings related to the matter earlier, but they were deleted because more than six months had passed and we had no reason to believe the issue would even arise . This timing has made us suspect that someone may have informed him about the deletion of those recordings, although that is a separate concern. My mother explained that the total profit itself was only โ‚น4 lakhs and that she had already paid him, while also bearing labour and operational expenses. He had minimal involvement in the work beyond supervision. Despite this, the police pressured us into settling the matter by paying him โ‚น50,000, which we did.

        Now he has sent another legal notice alleging that on 25 April my mother abused him using caste-based slurs and is attempting to bring an SC/ST Act complaint against her. We believe this allegation is completely false and intended only to extort more money. The notice itself contains the wrong flat number, although the apartment/building is correctly mentioned. My mother is a Stage 2 cancer survivor currently on chemotherapy tablets, had already stopped working and closed her business since April 2025 due to her health, and had returned from Vellore for treatment on 9 April. No one visited our home since we came back except family members. We live in an apartment complex with CCTV coverage in the parking/common areas, and our neighbors can confirm that this person did not come to our house.

        Given these facts, I would appreciate advice on how to defend against these allegations, whether we can file a counter-complaint for harassment/extortion/false allegations, whether any action can be taken against the lawyer knowingly assisting with repeated false claims, and what evidence we should preserve immediately to protect my mother.

          hey advocate this side,

          Take this seriously and consult a lawyer immediately. Preserve CCTV footage, medical records, notices, payment proof, and all messages. Do not contact him directly. You can defend false allegations with evidence and witness statements. You may also file counter complaint for harassment and extortion. Send a legal reply to the notice through your advocate. Act quickly because SC/ST matters are sensitive legally. feel free to message me if u need help

              Lawyer here.
              I must press the urgency of this matter given the allegation of using cast slurs which falls under the SC/ST Act . These are serious and must be countered immediately.
              With regards to the FIR – get it quashed from the concerned High Court.
              If there has been a settlement- do you have anything in writing evidencing the same?
              Immediately consult an advocate and send a reply to the legal notice.
              Initiate a criminal complaint against the contractor putting every fact on record before he approaches the police.

                  i just went down for cc tv footage and guard said it had 15 days of footage but the last recording available on it was of 29th april but rest we have everything i m trying to get footages from nearby cctvs

                      CCTV is just one aspect, if that trail is compromised, focus on other elements too.

                          yes he mentioned wrong flat number he claime he came with his 3 helpers to a home where my mom and wife stays alone during day time

                              He doesn’t need to actually come to your place, the act of inducing fear so that you hand over money to him is enough to trigger a criminal complaint. If he has come, it will bring it into attempt category but in absence of proof, this is enough. Moreover, if you have it on record stating that he came to your apartment, simply show it to the police personnel registering your FIR and the Investigating Officer will do the rest of the finding including combing through CCTV footage.

                        this sounds extremely stressful especially because it keeps escalating into new allegations after the earlier settlement which naturally makes it feel less like a genuine dispute and more like ongoing pressure the part that usually matters most in situations like this is building a clean timeline with whatever objective proof still exists like payments medical records cctv availability and communication gaps because once multiple allegations start coming one after another consistency becomes very important also the wrong address detail and your mothers health condition could become relevant later have you already tried securing the apartment cctv footage or visitor records from around the date he claims the incident happened before that data gets overwritten

                            no cc tv had data till 29th although it supposed to be for 15 days but i am trying to check and get clips from nearby apartments and homes

                              also we hve other proofs we also submitted and got the receipt from police station but still after 4 month he sent this also he mentioned 4 male name and in my home my mom stays alone what if he really tries it and try to enter my home for real also wrong mention of flat number is also a proof as that flat doesnt even exist

                              Quash the FIR by filing a petition before High court and further reply to that notice
