So what happened is during an ongoing exam a childs phone rang in his bag. which lead to the checking of all the bags that belonged to the students of his class. after that a teacher came to our class and demanded our phones saying that if we give them up willingly they will be returned to us by the end of the school day. this was not true. up to 25 phones were confiscated. they are refusing to talk to us or listen to our plea. they already are refusing to talk to the parents saying that phones will be returned after we have passed the class 12th board and are leaving the school for context were at the end of grade 11 now. i would understand if they caught us using our phone mid class. but most of us had our phones with us because we have to go to our coaching centres and classes straight from the school. what should we do and how to proceed?

As a minor, you can’t do much. Involve Parents and let them talk. The parents will have to visit the school physically.

They are illegally keeping the phone in their possession. Even if the phone doesn’t belong to you, it still is a property of your parents.

However, truth be told, if its a private school, and they have written rules and regulations that say phones are prohibited in the school, then even your parents will have to comply a little or negotiate a little unless you want to get kicked out from their school.

Parents will have to physically be present at the school. If they deny at that time, your parent can claim that the school is keeping their property, which is not legal.

But the principal can counter by showing their rules and say if you want the phone, then we will proceed with TC, etc…

Let your parents decide and talk it out to the principal. They are adults and can negotiate better.

The only possibility of getting the phone back is

Your parents can simply claim they won’t pay next year fees unless they give the phone back.

The school can’t kick you out easily because of CBSE and board guidelines.

                  So that’s the safest bet.

Happened in my school too. No one was able to do anything until students passed 12th. The other comment suggesting parents need to negotiate is safest bet.

if students needed to keep the phones for coaching centres, then they should have mentioned this before hand to the school.

How can they even keep phones for so long?

Are phones not allowed in the school? If not allowed then why do students carry them?

Yes they can keep it just like that. It’s extremely common for phones not being allowed in schools. You should be thankful that school is atleast returning them. I heard of some schools who never returned the devices.

Students are mischievous. I was. Doing something not allowed is what many students love to do to look cool. I will repeat, students should have got permission beforehand to keep the phone.

Damn that’s harsh. But like someone else pointed out kids need to go to this tution that coaching and so on. It’s not possible for every parent to come pick their kids and drop them off to that other place. Or even in other cases, having a phone ensures your child can contact you if in need.

Maybe from class 10 or above they should allow to carry phones but keep them in bags. Confiscate if caught using in school.

See we too faced the same situation as one of our lecturer said he will handover all the phones by evening if everyone handovers their phones and other electronic gadgets voluntarily,

But will confiscate those of found in checking

So everyone handedover all the phones.

But we know that’s not gonna happen once they got hold of our devices.

So sneakily kept them away from bags and never handedover them.

By the lunch time nearly 100-150 phones were confiscated and the hod simply said bring your parents if you want your phones back.

Me and my friend nearly escaped that but most people didn’t.

So when every parent have to come and listent to the rants of hod and other lecturers ,

Some parents simply said okay we won’t send our kids with phone but can you assure on paper that nothing will happen to anyone student even during night times especially female students and those who travells long distances .

Hod got the point as our college is so far away from anything atleast 5km on either side of the road .

So he silently handed over all the devices for the parents who came in 2,3 days and later just gave away for remaining people who are non local by getting a sorry letters from non local students.

So parents unity and students talking about safety should be told boldly or else colleges will make this like they confiscated some drugs or weapons from students and they are the only ones who can discipline the students no matter how fucked up they are in other fields.

i dont it was not like i was using my phone in class it was in my bag which was kept outside for the exam. the thing is i need my phone to contact my parents and coordinate with the coaching centres for the classes because sometimes i have to go to the centre directly after school. the issue is not that they have confiscated it. it is that they are refusing to return it or even talk to our parents. more than half a dozen phones were taken and some of them were pretty expensive. the principal refuses to coordinate or even meet my father when we were at the reception after school hours had ended.

It may be important for a lot many students, especially high schoolers (11-12th students) who go to coaching and/or tuitions directly after schools. Especially non medical people. For someone like me, whose home was 45 minutes away from school, phone was very important for communicating with my mother because at times, she wouldnโ€™t be at home and iโ€™d have to wait it out in the society. Nowadays, some schools even allow small children to bring basic phones (mind, not smart phones) with important contacts fed in them, for the purpose. Ofc, with due permission and everything.

Bhai sun Meri baat Very imp, little risk but high reward. u/RajShivansh

Bhai in your school the phones must have been kept altogether na? Because they cant keep them all at seperate places ok. Now listen carefully, if your phone has also been taken away then you must just locate this location of phones, check the most probable places only. The school will not take any great efforts to hide them or lock them in any safes. Now bas ghus jana kisi bahane se reception ya jaha bhi phones rehte hai. Agar koi maushi and all dost hai to unse baat karle. Har school me kabhi na lkabhi to lunch ke liye bahar jate hoge na us room se, jo surely empty rehta hai kisi na kisi time pe. Now just quietly sneak your phone out of that box ok? And now tu bolega ki 25 no. ki counting hai unke paas, bhai vo har din nahi count karenge numbers and they wont know ki jo phone gayab hua hai vo kiska hai. Just keep an eye out for cams etc.

Please this was only if you wanted Sasta Tom Cruise level shit, ok?? Do it only when you are desperate.

Please me ye bolra hu ki police complain and all mat karo as this will spoil your rep. and relations in school. The better way is ki sab parents pressure dalo, 25 parents ka pressure bohot hota hai institutes ya school k liye, and jis bacche ki galti thi uske taraf se koi formal apology karva do. This will be the best. Plus agar unlogo ne to bhi 8-10 din me to u can do the mission Impossible lol.

I hope ki tujhe phone wapas mile. Keep us updated!!

At that time the parents let it cool down for 3-4 days, then came to the school as a group and one of them was an advocate and he printed out a legal notice (or so Iโ€™ve heard) and they approached the principal and asked for her receiving on the notice and declared that they will not pay school fees as their phones were expensive enough to be considered security against it. The principal said ok and everyone went home, then 2-3 days later the parents were called again and the phones were returned.

I can confirm that the phones were returned within a week but I canโ€™t confirm whether the legal notice and holding back fees thing is legit as I was not involved.
