        Hello everyone ,
I am posting this with a lot of fear, hoping someone can guide me.

Tonight around 8 PM, my 66-year-old father, a retired officer from a Coal India company, was physically assaulted by a group of people from our own lane in Ranchi, Jharkhand. The attack was completely unprovoked. My father is a simple, peaceful man who has always lived with dignity. The people who attacked him are locally influential and wealthy.

I live outside and will be reaching home tomorrow afternoon. My sister went to the police station, which is just 100 meters from our house, and filed a written complaint. We have a copy of it. But the police just told us, “We’ll see to it tomorrow,” and did nothing else. Meanwhile, the assaulters are still around, freely walking in the same area, and we’re extremely scared. My father is in a state of shock and my family is shaken. We are afraid something worse could happen if we push too hard, but we also can’t sit silently.

I don’t know what to do next or how to ensure my family’s safety. If anyone here has legal knowledge or has faced something similar, please tell me what steps we can take now.

        Thanks.

Reach police station Tommorow, ask them to write FiR and take ur father for medical and secure CCtv if any , …if they deny or neglect then immediately approach to senior police officer SP / Commissioner with written complaint if that doesn’t work then do approach local advocate for filling complaint to judicial magistrate.

Trick of the trade : when someone assaults u never limit ur police complaint to just assault… aggravate it to robbery like they snatched Gold ring Chain etc and if there were 5& more ppl that becomes Dacoity, which is of the most heinous and serious &non bailable offences. So when Police Files FIR arrest becomes imperative or if they still resist writing down FIR , on Complaint ,Judicial magistrate has to take cognizance of such serious offence.

NAL, is it ok to lie in police report? Any consequences if caught? Also will police ask for invoice of gold ring/chain stolen or something?

I never had to go to police, just asking for knowledge that might come in handy

Yess that’s police job to find out truth and present their findings before the court which we call chargesheet which is the next process after FIR and that takes time and effort and Until hat period accused can be kept behind the bars in heinous & serious offences.
no invoice will be needed Simply u have to say it was old ring or family ring ..

Reason I am suggesting this cause punishment for assault is three months or fine and for simple injury is one year or fine ..such case hardly reach its conclusion…you will also lose your zeal to pursue the case after initial anger settles in. Since India has one of the worst conviction rate in whole world , here punishment lies in the process, the more you make it harder for person the more he suffers.. obtaining bail in such case is not easy or atleast a very expensive process.

Apparently, for no apparent reason, a group of people blocked our small lane to enter. My father was on a scooter, and the car (a Scorpio) was trying to squeeze through the narrow part of the lane. He asked them to reverse the car a bit so that he could get out, but they told him to get aside and let the car pass. He explained that it was impossible because of the construction material lying there, and there wouldn’t be much space at all. They immediately got out of the car and charged at them. As the noise escalated, my uncle, who is around 70 years old, ran to my father for his rescue. They caught him too. With more noise and people around our home, they sat in the car and left.

Hi. I’m a lawyer here. Try registering a FIR once again and be a little stern about it, especially in light of the incident that has transpired. Also, inform the police to provide your father some protection as you’re apprehending danger, and if that doesn’t work, please take a lawyer with you, to do the needful. It’s your right and there is no way the same can be denied to you.
