So let me give uh the context like what happens
So me and boyfriend started dating almost a year ago..
Everything seems very good and nice to me.. and thn like when we starting meeting frequently he told me about his past ..
So basically ik his past his ex gf..
Now what happens randomly a clip of his and his ex girlfriend got viral by his bestfriend (his bestfriend did this to him bcz they had fight at gym so he stole my boyfriend private videos and pics)out of anger jealousy…and leaked…idk tbh..
So we guys are in college he got immense hate and whatsoever
Everyone around us or basically around me said leave him ..
And what not..
Now his ex girlfriend basically cheated on him so and so…for context
And also it’s been like 7-8 months since there video got viral.. everything seems to be alright..
So out of no where her family members got to know about her sex tape ..
And they filed case against him..
And case was posco act :- basically case for rape in india..
Now thing is : he’s already in depression bcz of this thing..
Now thiss freaking case which cause him jail or death penalty for what nothing..
What should I do now??
He’s underground now bcz of the case ..
Idk what to do..
He’s innocent…..TLdr: My(21f) boyfriend (20M) gonna arrested due to his some personal videos and pics with his ex.. what should I do now????

And IF UT WAS TRUTH WHICH I HOPE IT IS, I don’t think anything will change and fking a girl/guy willingly and intentionally knowingly etc that’s fked up when it’s not gonna be marriage thingy. BLawyer here- was her ex under 18 when they did xxx? If she was underage than posco applies if she was 18+ than posco doesn’t apply and therefore he will be alright if they can prove mutual consent

LProbably she is below 16 or even 18, she said Ex must have happened much before.
I don’t think the daughter will accept a mutual consent, in front of the court, since her family will pressurise her not to.-
BVideo can prove if she gave consent or not.
Although video is not allowed without consent either, but his lawyer can try to prove consent.
Only issue being if she was 16,17 than even her consent is no consent ans he will go to jail 100% you can’t do anything about it what he did is considered rape if she was under 18

As if it’s a justification? it IS sexual harassment, no he’s not innocent. And yes her parents should have filed that case. Idk why you’re expecting a woman’s sex tape being circulated around college and the man responsible for it should be left free? He does not seem to be as innocent as you think he is. RIt won’t change circumstances for application of pocso act, but it would also invite Juvenile justice act. The act that governs how “children in conflict with law” (the legal term for under 18 criminals) are treated. That basically means no jail, no handcuffs, no police custody in police station, child detention centers, and early bail and very less term of punishment.

TFirstly, if they were adults at the time, POCSO wouldn’t apply. You’ll need to hire a lawyer to clear his name.
His best friend could be jailed for this, if pursued correctly.
Honestly, kids these days don’t understand the repercussions of their actions. His best friend leaked such footage for revenge, and your boyfriend kept these videos on his unsecured phone.

PI highly suggest him to get the CCTV photoages of the fight b/w him and his friend when he’s taking out the videos.
Surrender to the police while getting the anticipatory bail order on health or any relevant grounds.
Give deposition that those videos was in phone and leaked by him (his estranged friend). They had consensual acts and show proofs of dating.

MYo Yo Yo everything was alright until I saw POCSO. Seriously your boyfriend’s ex is a minor?? HE WAS IN A RELATIONSHIP WITH A MINOR. A VIDEO OF A MINOR GOT RELEASED?? This is a very serious issue. As far as I know, Although, whatever that had happened between is with both of their consent, the law still takes it as a sexual abuse against children. Also in addition there is the circulation of CP getting added to it. Multiple sections can be filed.
I am unsure of the bail, but one can still argue the case on humanitarian grounds such as intentional relationships etc. Consult your Lawyer.
The best thing to do, go and consult with the family and the girl’s family lawyer to not to get it into court. Although there is only a slim chance this can happen, still try it.
Advice for you… Do you think a person is having a relationship with a minor is innocent? Consider rethinking.

Also his friend “stole” his phone and “leaked” the video. Excuse as old as camera phones have been in hold of horny teens.
