        Took my senior citizen mother to the bank last week and their flooring was hazardous due to which mum broke and fractured her left wrist. The bank guy came to the hospital saying he could get us a discount at the charges we would incur and then again visited home to talk about a loan. There was nothing about a compensation for the physical and mental harassment caused at the accident. I want to know if I can press charges at them and ask them to compensate the full medical expenses and also for the harassment we faced. My point is, they didnโ€™t even bother about my mother or her injury and were very sure we would sue them, which is why they came, hoping to wrap up with a small amount. They even told us that another customer too had a fatal accident like this but it wasnโ€™t as severe as mums. I havenโ€™t been able to contact them in the last 2-4 days cause I havenโ€™t been busy taking her to the doctors and all.

        Any suggestion on how I can go about this? Thank you in advance.

          Ouch this sucks, name the bank and branch here.

          File and FIR first with the police.

          Send them a legal notice to save the CCTV footage, else they will delete it and then your evidence is gone

          Good luck with your mother’s health and hospitalization.

              Hi, thank you. The bank is HDFC, Kolkata. Itโ€™s been a week, so is there a possibility that they may have already deleted it? Also, do I contact the bank people first?

                  I am not a lawyer, but just using my knowledge.

                  Hand deliver and receiving of the letter asking them to preserve the video, generally it will be deleted in a few days. Tell them that you are currently in great distress to take further action.

                  Ask a lawyer to do the same.

                  Make sure that you have filed and FIR, the police will also take the CCTV footage as evidence.

                  The police have been instructed to look after senior citizens, so make sure that you ask for that privilege from them.

                      Thank you. I really appreciate the suggestions and will look to do something along these lines. Been really jittery since the whole incident.

                  Why was the floor hazardous? Was it wet? Did they have warnings?

                      They had glazed tiles which were slippery and those rolling chairs. No, there was no sign suggesting the floors might be an issue.
