        My MIL is facing a hard battle trying to sell of her share of inherited land. They are 5 sisters and 3 brothers. The partition of the land has already been done. Nobody lives in the vicinity except the youngest brother who inherited the ancestral home and lives there currently.

        Now 3 of the sisters – who are under severe financial stress – have been trying to sell off their share of the partitioned land. But whenever a potential buyers visit the property with interest to buy the land, the youngest brother creates some scene (making up stories that it is a disputed land) scaring the buyers away. All efforts to negotiate with said brother has been made but to no avail. What can be done in this situation? The sisters have even approached the local police station and the officers agreed to help. But the problem is that neither the police nor the sisters can be at the location all the time. And this brother is the only one who lives in that area so anyone who visits will end up crossing paths with this guy and the deal will not happen.

        The three sisters are into their 60s and have debt to pay off. All other siblings are in agreement, it’s just this one guy who’s deliberately stalling the sale.

        What is the legal recourse? Or can anyone suggest any other solution? I don’t think this is a very uncommon problem in India. So hoping someone will be able to share insights from their experience or using legal expertise.

        Would really appreciate any help you can offer.

        More information: This brother is married and lives with his wife but they don’t have children. No one really knows what his objective is. We are only guessing that he might be thinking he’ll get ownership of all the land eventually since no one else is planning relocate and build a house there. So if sale doesn’t happen, he probably thinks he’ll get control of the whole place even though it is not in his name legally post-partition.

          Fence off the partitioned portions and show proofs (7/12 etc.) to potential buyers early in the discussions.

          Land buyers generally know that this kind of family drama happens. Gain their trust by showing that the paperwork is perfect.

              Sellers can directly work with the buyers or through the brokers . explaining the reality before showing the property….clear fencing and documents will help….other option is if someone in relatives or known circle who knows the reality can buy the property
