UI 19 (M) has been in a relationship for 7 months with a 17 (F) that turned 18 this month and we have sexted in the past tho exchange of Nudes didn’t take place I did asl her once but she refused and I didn’t persuade any further nor have i brought it up again but we have indulged ourselves in sexting over the time so I was wondering if the girl was to book me under POCSO act right now will it be applicable? Even tho she’s 18 now and no we haven’t indulged ourselves in any sexual acts makeout, kissing, Sex or anything of that sort it’s just Sexting on text.

BThere is no limitation period for criminal cases and the fact that she is an adult now is not very useful for you, even if the sexting was consensual.

USo what does one do in a situation like this? How do you possibly get in trouble if it was consensual?

SJust don’t break up with her on bad terms. Spoil her with chocolate and make her fat and make her hate herself and then make her break up with you.

BThe issue is that under the POCSO Act, consent is not a defense when one party is under 18. The law is designed to protect minors from exploitation, but it also applies in cases where there was no coercion.

BIf you are genuinely apprehensive that a case might be filed, applying for anticipatory bail could be a precautionary step.
