        My sister is thinking of divorcing her husband on grounds of anger issues. He has also been diagnosed with a personal disorder by a Psychiatrist. My sister earns more but he has much more through savings and investments. We want to settle out of court mutually but don’t know whether he will agree. How bad can it get (how many years and potential costs) and can he ask for alimony? (my sister has little to no accumulated savings)

          If both parties agree, the process can take a few months to a year, depending on jurisdiction. Fees are minimized. But if you go for contested, it could drag on for 2-7 yrs, with huge legal costs.
          Generally, husbands don’t get alimony in India unless they are financially dependent. But under Section 24 of the Hindu Marriage Act, he can claim interim maintenance, if he proves financial hardship. If he asks for that, your sister must prove his financial stability and he is capable of earning.

            If someone wants to get away from an abusive person then what has it to do with any of the life savings? 🌚

              Mutual Consent divorce is what she has to apply and get the order from the court. there is non Out of Court settlement for Divorce. Both have to discuss and agree on the terms and conditions of the separation first. If he is also earning there is no question of alimony or maintenance that your sister has to give him. Once they are in consensus with the terms of divorce, a joint petition to be filed before the court.
