        Hi all,
        I have a question about notice periods in India.

        When I joined my company, my appointment letter said there is a 1-month notice if I resign.
        But now, the management sent an email last month saying the notice period is changed to 3 months for everyone.

        I am planning to resign now, and want to know:

        1. Can they change the notice period just like that, by email?

        2. If I didn’t agree to this change, is it still legal?

        3. If I resign, will the 1-month rule in my appointment letter still work?

        Please share your thoughts or any advice. Thanks!

          No it’s not enforceable. You can let them know that you aren’t agreeing to the notice period change.

              But wouldn’t they say, why were you silent for the entire previous month?

                  If you don’t speak up now, you will never get to speak. You can say I needed time to weigh my options.

                      So what should I do now? Resign and let them know that I’ll only serve one month notice period as mentioned in the appointment letter

                  Unilateral change of contract is not binding on you. Just say you don’t agree to the change since the appointment letter mentioned 1 month and resign.

                      Thanks for your help, again but they will point it out that why you didn’t respond then and there itself that you don’t agree to new notice period, they can question my silence…

                          Just tell them you were discussing with your lawyer and now that disucssion has been completed you don’t agree.
