May 5, 2025 at 10:02 amActually when i was in my college i started lending buisness to my friends .Small amount and was charging 10% interest.2 of my very close friends took around 3 lakh and 3lakhs from me and promised to give interest every month and principal back but what happened is now they are not giving me my money back and its already been more than 1 year or so.I also have a affidavit mentioning promised date,amount and agree signature of both the parties.So what can i do now to recover my money? -

May 5, 2025 at 10:29 amHi. Iโm a Delhi based lawyer. Hope none of it was a cash transaction. Also, what was the duration for which the loan was given? You can send them a legal notice seeking recovery of your money, to begin with. -

May 5, 2025 at 12:28 pmFirst things to consider is whether or not there was a term specified in the agreement/affidavit you are referring to and if there are other terms at play.I would begin with issuing a legal notice seeking recovery of dues. If they do not pay upon notice you would be required to initiate a civil suit before a court of competent jurisdiction.
If it was a cash transaction you would have to prove how and where the amount was paid? Did you legally have access to funds in cash at the time? As per a recent Supreme Court judgement all cases containing mention of cash transactions above 2 lakh have to be reported to Income Tax Authorities. (The Correspondence, RBANMS Educational Institution versus B. Gunashekar & Another, Civil Appeal No. 5200 of 2025)
