We are planning to sell T-shirts Online on our own website in India.
Need to know as T-shirts come under **loose garments** under Legal Metrology, what are the **LABLE GUIDELINES?**
As per our knowledge the guidelines state that *”name and address of manufacturer* ***or*** *marketer* ***or*** *brand owner* ***or*** *importer* ***or*** *seller with the country of origin* ***or*** *manufacture in the case of imported products;”*
We prefer **NOT** to mention the name of our manufacturer. Instead we are OK in writing ***Manufactured for or Marketed by.*** Is that legally acceptable?

Also, when we order T-shirts from other Marketplaces like MYNTRA, FLIPKART, AMAZON, etc, their Labels have **MANUFACTURER’s ADDRESS & MARKETED BY Address** both separately. Why are they writing both when there is no such legal requirement?

If one company manufactures and any other(not parent/subsidiary/associate co.) sales(incl. distribution), then BOTH needs to be mentioned. Refer Legal Metrology Act, 2009 and CPA, 2019 along with rules.

What if there is a Non-Disclosure Agreement Signed between the Manufacturer & Seller, which does not permit the Seller to Publish the name of the Manufacturer? How will that work?

As mentioned above, CPA read with LMA majorly deals with it. Contract cannot supersede statue. So,NDAs won’t work. If your objective is to protect your manufacturer’s identity then just create CiM( company in middle).
