UHello guys,
I have recently decided to rent a flat in Mumbai. The apartment is really good, near to my workplace and the rent is in my budget.The problem I’m facing is,
1) The agreement is signed but it says 4.20L as deposit amount which will be paid between 4 people that come to 1.05L per person but the individual amount per person isn’t mentioned. My rent is 30K which would get the deposit to 90K but still it’s 1.05L as everyone is spitting equally
2) Someone in the apartment has told me to not speak to owner because she doesn’t wanna get involved in anything (rent, deposit etc) as it would require her to check everything and the rent will be increased (she doesn’t stay in India)
3) The person who is staying there for a while is managing everything, has told me to transfer the deposit to the person I will be replacing as they had done the same, considering the owner doesn’t want to be a part of anything.
4) The broker pushed me a lot today to pay the brokerage so he can get a date fixed for society meeting. When I said I will do a F2F transaction where I get the agreement hardcopy and he gets the money he hesitated for a bit, asked me to pay brokerage and he will deliver the hardcopy but I convinced him for F2F transaction.
I don’t know but the deposit part is feeling off, like I won’t have any transaction with the owner directly, can they refuse me to stay there or refuse to refund my deposit citing that my deposit was not paid and that 1.05L was paid to some anonymous person whom they refuse to recognize?
I’m over thinking but it’s a lot of money… Any brokers or landlords here who can help me?
The agreement is signed and sorted.. Any preventions I can take?
Help me please.
PS – He will collect brokerage from office tomorrow morning, seeking for a solution before that

MI am a lawyer. Deposit can be refused in future because there is no transaction. I agree there is an agreement but for proof of payment you do not have anything with the owner. Beware of this.

UOkay, also when I spoke to the person managing everything he said that the owner won’t give me a deposit. I will have to claim it from the person who will replace me… Is that any better? Also, thank you kind sir/ma’am

MWhen the replace will come at that time he will pay. Everything is on trust basis. I would highlight this as a risk.
