She was pushed into this marriage with her husband (M29), who works in a prestigious government department and was initially seen as a “good man.” But now, she has confided in me about the horrors she’s facing behind closed doors.Right after marriage, he forced her to do
things against her will, including anal and oral sex, despite knowing he has a nasty skin infection. When she refused, he physically assaulted her.
Turns out, he has a serious drinking problem and regularly consumes ghutka, and smokes something he and his family conveniently hid before marriage.
She is now desperate to escape, but her orthodox parents won’t support her and believe she should “adjust” because of “family honor.”
She has nowhere to turn, and I’m trying to figure out the best way for her to legally and safely get out of this marriage. Given that her husband holds a government job, what would be the best legal strategy can she file for annulment or should she pursue a divorce on cruelty grounds? Can his position in a government department and connections be used against her?
Any advice from legal experts would be greatly appreciated. -

March 8, 2025 at 4:44 pmYeah he’s right. Marital rape is permissible under Indian law. There is enough precedence for that. Our legislators could have easily changed that if they wanted to, but that might also impact them.It is definitely not right, but that is the law.

Step 2: Get evidence of abuse – pictures, recording, MLR from a govt hospital. Most of government power doesn’t stand ground in front of a strong evidence.
Step 3: Give a police statement on Domestic Violence attaching the evidence. (Section 498). Police might not register an FIR immediately, which is okay.
Step4: They will refer to Women Station, which will take it forward.These are bare minimum to ensure your friend is positioned to win, and no power can make police ignore her case. Then your friend can decide to lawyer up and press for FIR is she wish to
Annulment will be best. Most likely the husband will come to negotiating table once he sees a police complaint against him(even if it’s not an FIR).
