        I work in IT. My client buyed out all my colleagues and me as they started a separate setup. My employer also agreed to it and accepted our resignations and mail us our experience and reliving certificates. It was like a direct transfer and we were told not to serve any notice period. Later when asked for put original certicates we were told to pay the 3 months salary to obtain it from them. Im helpless what should i do?

          If your resignation was accepted without notice period and no dues were mentioned, then they waived their right to recover notice pay.

          No employer has the legal right to retain an employee’s original educational or identity documents.

          This violates Articles 19(1)(g) and 21 of the Constitution (right to profession and life).

          Also goes against Labour Ministry guidelines and can be challenged in court.

              We were given a verbal agreement which they denied later and i also have recording regarding them asking money.
