        Hello everyone,

        I need some legal advice regarding an ongoing issue with my neighbour who has blocked a public road west of my house. The road was completely blocked by my neighbour back in the 1980s. Recently, they started demolishing their old house to build a new one, and I raised a complaint with the municipal corporation, providing proof and asking them to request the neighbour’s land registry to confirm their property boundaries. This could help in clearing the encroachment.

        Here’s the issue:
        An ex-parshad (who served three terms) from the BJP is supporting my neighbour, and during an inspection by a Junior Engineer, it seems they bribed him. We escalated the matter to the Deputy Commissioner (DC) of the zone, who issued a notice to the neighbour to halt construction until the matter is resolved. Despite this, construction continues uninterrupted.

        We’ve now submitted an application to the higher authority, the Commissioner of the Municipal Corporation, last Saturday. However, the DC seems to be under political pressure, and there’s been no action. The DC suggested we approach the court instead. In the meantime, we’re also planning to meet with the Mayor, as we’ve already submitted the complaint to the commissioner of the municipal corporation.

        Additionally, the current land registry for my neighbour’s property appears to be manipulated, particularly regarding the aerial measurements. We’re trying to obtain the original registry ( preciding to current one ) from the Collectorate, but the process is slow due to the aforementioned discrepancies with the current one.

        The original registry is crucial for us to obtain a stay order from the court to stop the illegal encroachment, but this is taking time. Meanwhile, the municipal corporation isn’t acting due to political interference.

        This issue is occurring in a tier 1 city in Rajasthan. If you need any clarity about anything mentioned above, please feel free to ask.

        Has anyone experienced something similar or have any suggestions for further action? I would really appreciate guidance on how to proceed, especially in a situation involving political pressure and delays in obtaining necessary documents.

          If you possess any political reach then use it or else i believe there’s nothing you can do as political involvement in such scenarios makes it difficult for the responsible authorities to take any serious action.

              Political reach is the thing i do not have that is why I am asking about the legal procedure here which will make authorities take action. Thanks

                File RTI Application to get whatever documents you need. There are fixed timelines as per RTI Act and they have to adhere to it.

                You will need to file your case in court and obtain injunction to stop construction. Make the municipal corporation & other involved departments a party to the Suit too.
