January 14, 2025 at 7:37 amCurrently I’m working as asst. sales manager in an indian company, i am switching to another company which is direct competition of my current company, in a totally different role as technical applications.I have already resigned and serving 90 days notice period, and i have completed 70 days out of it.
MD of the company knows where I’m going, and he has told me, as per appointment letter we have no competition clause and you cannot join competition in any role.
Now they have not paid me from last 2 months and also may not give relieving letter.
Can they take legal action against me ? and if they do what can i do in that case?
P.s. appointment letter which i have signed states ” post job resignation, you for a period of 1 year shall not join/assist/ provide any service to any direct competitor of the company directly or indirectly.

January 14, 2025 at 7:44 amBuddy, can you frame your sentence properly? In one paragraph you say no competition clause and in the end you say there’s a competition clause clearly mentioned in your appointment letter.-
