I’m a UK resident (not Indian), and I’m hoping someone can guide me on how to proceed legally or practically.Back in April 2022, I paid an Indian company called Fash Neo (formerly known as Fashion and Stylish) £78 for a dress. This wasn’t my first time purchasing from them, so I trusted them. Unfortunately, this time they claimed they were out of stock/size and couldn’t deliver. I requested a refund, but they made excuses, saying it was Eid and that issuing a refund through PayPal would cause them issues.
Since then, it’s been a game of chasing them. Every time I reach out, they either ignore me for weeks/months or send pictures of available dresses, promising to get back to me—but never following through. I’m a full-time carer for my elderly parents, so I haven’t been able to stay on top of it constantly, but I’ve tried to keep following up.
Most recently, I again asked them to finally just send me a dress and to be lenient on pricing due to the 3-year delay. Still no clear resolution.
They’re apparently based in Surat, Gujarat, India.
Is there anything I can do legally from the UK side or through Indian consumer channels to push for a refund or resolution? Any advice on how to handle this without physically being in India would be greatly appreciated.

April 25, 2025 at 6:22 amThats bad. If you have an Indian friend ask them to raise a complaint via consumer helpline in India (it requires indian phone number as far as I recall).
When I was in India, I once had a similar situation with Bata which is a very famous and reputed brand.
They didn’t provide the refund even after 7-8 months. Raised on consumer helpline and it was solved within a week-

But like you mentioned it will need an Indian phone number 😭-

April 25, 2025 at 8:40 amYeah it’s legit, but you do need an Indian number to use it. It’s basically Indian small claims court but fully online and super easy to use.

April 25, 2025 at 6:44 ampaypal has a protection for 6 months, thats the only reason i use paypal, and if a seller isnt shipping your product in that 6 months period, you can easily apply for refund saying product isnt delivered.also why arent you mentioning their name? you should mention their name, shame them on twitter and also on their social media handle saying they scammed you.
go to their twitter, share the message they sent publicly, and create a scene.

April 25, 2025 at 7:53 amA lawyer here. You can get a legal notice sent followed by a civil suit for money recovery against the seller. I hope you have made the payment through bank instead of cash. If you have a purchase order or invoice for that transaction, that’s a cherry on the top. It is not a hopeless case. You must give it a try.You also don’t need to be in India to get this done.

April 25, 2025 at 10:13 amI am not a lawyer.The total amount in question seems to be something like Rs. 8500 (or its equivalent in Pounds). Is it really worth doing this? Would she get any money at the end of it (after lawyer fees etc.?)
My wife is a lawyer. She charges Rs 5000 – Rs 10,000 for a legal notice. Isn’t this amount too low unless you can do something in the consumer forum.

And nothing worthwhile can be done in consumer court without paying a decent legal fee.

April 26, 2025 at 4:54 pmFirst of all, it seems you have just crossed the “Limitation period,” as the entire transaction completed over 3 years ago. According to the Indian Consumer Protection Act 2019, a complaint must be filed within 3 years of such transactions. Unfortunately, this means your legal options may be limited at this point.To pursue any action, you might need to hire a local attorney in Surat, India who can provide guidance on potential next steps or explore alternative resolutions with the company.
