        We purchased a flat in a standalone apartment in October 2024. Owners were living in that flat and they informed us that they’ll vacate the house 2 months after registration. Registration happened in late october.

        It’s been more than 5 months now and they’re not vacating the flat. Every time they would commit to a date and later push it by 15 days giving some excuse.

        What are our options?

          If it’s a registered sale deed then get the cops. That’s it

              It’s a small town we don’t have a rental agreement but sale deed is there

                  Just cut electricity and take meter out and create ruckus. Also take out main door by calling carpenter.

                    Have you been accepting rent from them? If yes, then this establishes tenant landlord relationship and police won’t interfere.

                        Yeah we’re accepting rent. Initial agreement was to let them stay for 2 months

                            Then it would be a civil case of eviction. I can’t understand why people do such things.

                        Too late mate. You should have with held payment till you get possession.

                        Stop being nice give them a notice in writing to vacate in 30 days. After that head to the electricity department and temporarily disconnect the electricity connection.

                        If this is not done you are headed for the courts.

                          Lawyer here, based in Delhi.

                          Since the sale is complete and registered, you are the lawful owner of the flat. If the previous owners are refusing to vacate despite clear terms, they are now in unlawful possession. You can first send a formal legal notice asking them to vacate by a fixed date. If they still do not comply, you can file a civil suit for possession and damages.

                                since its their property, what happens if they decide to walk in with 2 or 3 other people and throw out the belongings of the squatters from a legal point of view?

                                  Similar situation, but as long as the owner is accepting rent, the tenant doesn’t need to vacate.

                                  My friend pulled off a borderline illegal move to get his apartment back.

                                  Through a third party, he convinced the tenants they had won a vacation package—complete with a cab ride to Shirdi and a ₹10,000 cash prize. The moment they left, he wasted no time. An old truck rolled in, packed up everything, and was out before they even knew what hit them. If things escalated, worst case? The truck gets stuck in a police station for a while—no big deal.

                                  He didn’t want to negotiate from a weak position, and the legal route would’ve taken 1-3 years. As expected, the tenants raised hell, threatened cases, and made a scene. But in the end, he got what he wanted.

                                  Total cost? ₹1 lakh—including bribes to the local police, movers, transport, and lawyer fees.
