There was this ex colleague who was continuously abusing me on call and I went to PS and they asked me to give written complaint, they called the guy , slapped him and put him in murga pose , he was there in same pose for whole time and when i left PS he was still in same pose. Then they made him write apology letter and i gave my signature on that. It has been two months back. he did not call after that. However, the cops called me today and asked that how i m doing? if i want to file an FIR? Then what was the previous proceedings?

If he’s not disturbing after that PS visit no need for FIR ig. He has parted ways and let it be, why open a closed book.

i dont understand why police called me again. I thought it is always over. They asked me to provide confirmation on whatsapp regarding FIR filing (official whatsapp number of PS)

Police might check back to see if all is well. Or this could also be a system generated mail. Not being negative just my speculation but he may also have contacted to get bribe from the other guy on this issue with a FIR.

File a FIR regardless just to stay on the safe side in case anything happens in the future. Remember if someone did something else they’ll 100% do it again if given the chance. Humans are terrible in general.

this is the only important question in the post: why the policeman called you, that too after 2 months. ignore it if things are okay.

Police would probably be checking up to file a Closure Report/Cancellation Report on the ground that the complainant, you did not wish to have an FIR registered. The apology he wrote and your counter-signature on it would most likely be treated as a settlement. Strictly speaking, police has no right to make parties enter into settlement agreements, and are bound to register an FIR upon receiving information of commission of a cognizable office; but that is how things have evolved in practice.

You have to take a decision if you wish to pursue the proceedings or not. As bad as I feel writing this, but once an FIR is registered, things will take their course, which would involve more questioning from you. If a Charge Sheet is filed and criminal case initiated before the Court, you’d also have to appear as the witness.

If you feel that the guy has learnt his lesson and is now leaving you alone, you might consider moving on and dropping the case without registration of FIR.

If he ever bothers you again, you may make a fresh complaint, but its weight might be diluted just a little bit.

On the other hand, if the guy is of a criminal mindset/obsessed/psycho, it might make sense to proceed with the FIR and further proceedings.

The guy should be prosecuted as per law. What happened to him is just another instance of routine police brutality. Such instances get ingrained into people, as they are publicly humiliating, and the resentment will brew and eventually again spill over into society. This is just systemic failure manifesting again.

Police did everything unlawful here to deliver perceived justice to both parties. What a joke!
