        So we have this roadside shop where my uncles and my father do business and over the years it has gained quite a value.

        Recently, I learned that this land is on my grandmothers name, I also learnt that the original papers were given to my uncle by my grandmother at some point, so me and my mom got grandma to ask uncle for the papers, his reply to grandma was “you never gave me any papers” After some forcing he brought grandma xerox papers and said to get original papers made by a lawyer.

        However I’m 100% sure he has the original documents hidden somewhere, and he may use them to transfer the land on his name after grandmas death (she’s the only one left now)

        What can i do here?

          People lose papers all the time. Get duplicates from the sub-registrar office.

              The normal course of action when papers are lost:

              1. File an FIR. This will create an official record of the loss. Keep a copy of the FIR.

              2. Publish a public notice – preferably in two papers, Hindi and English. In the notice you must declare the loss of the property papers and state your intention to apply for duplicates. Keep a copy of the newspapers with you.

              3. Apply for a certified copy of the documents from the sub-registrars office.

              However, it is always preferable to have the original documents with you if you ever plan to sell, so keep searching for the papers and asking your uncle from time to time.

                    Get attested copies from revenue department. Inform your uncle after receiving them. Papers your uncle hold would be worth only the cost of paper they are printed on.

                        You got good advice here. Lodge FIR, take it to registrar’s office, get application filed mentioning details as well as FIR copy. Even if Uncle has a motive, you have started prepping documents.

                            File partition suit for share in the property.
