        Hello, I’m a student residing in an apartment named Mahindra centralis in Pimpri, pune. there’s been an issue where the owner of the flat, as per the agreement was issuing fines for late payment of rent, which was fine because I agreed to clear any charges for late payment of rent. My agreement was to expire on 14th March 25, as per the agreement (expired now) but right before 5-10 days of the expiry of agreement, owner asked me to vacate his flat, and said he doesn’t want to continue with the agreement. I said alright, but I was unable to find another flat till the end of agreement, now he’s straightforward asking me to pay double the daily rent. Which is the questionable part since didn’t even give me a proper notice period that he wouldn’t be continuing the tenancy period any further. He didn’t do so and Is telling me to either vacate the flat or pay the charges or he will get an eviction notice against me.
        What should I do in such situation?
        P.s I started with a rent of 29,000 per month, in the March of 2023, after the end of 11 month contract, the owner revised the rent to almost 13% more, I.e, 33,000 per month, he also said if he were to continue with the tenancy, he’d charge Upto 37,000 per month as rent. There was no changes made to the flat, it has been the same since he gave it to me.

          What prior notice? The agreement has expired . You can pay the increased amount with a new agreement or leave.

              Notice stating that he wouldn’t continue with the agreement. I thought this was a page for legal advice?

                  When an agreement has a term there is no automatic obligation to renew. A clause for notice period is not applicable if agreement has ceased to exist.

                      Well, I went through with a few other people, found this that the Maharashtra rent control act 1999, it states that there has to be a proper notice period that is to be served, even after the end of rental agreement, there has to be a notice period that is to be given (often 15-30 days) and there’s no arbitrary eviction of tenant.

                          No one creates a rental agreement in Maharashtra. They create leave and licence agreements which are outside the purview of the rent control act.

                      Your agreement has expired yesterday, so unless you and your landlord were renewing, you should have been looking for an alternate arrangement or a new flat. Did you ask him if he’s going to renew your agreement? Because it’s not done by default. Neither does he have to give you a notice since you already know that’s the date the agreement ends. If you don’t think it’s worth continuing, you’re better off looking for something else and requesting him for some time or making temporary arrangements in the meantime.

                          Tell him you will pay due charges for late payment and vanish after 1 month because he won’t give your deposit back
