April 2, 2025 at 10:03 am**Unfair Security Deposit Deduction: Struggles with Our First Rental Experience**After living in our own flat for 25 years, we had to move out as the building was going for redevelopment. We found a nice 2BHK flat in the Thane region, where we lived for two years.
However, when our lease ended, the landlords were not willing to extend the agreement, as they wanted to sell the flat. Despite this, they also didn’t give us a clear indication of when we needed to move out.
Since we had already started looking for a new place, and flats were getting occupied quickly, we decided to move out without prior notice. Being our first time renting, we were unaware of certain rules.
Move-Out & Deposit Issues:
Before leaving, we painted the flat, spending ₹10,000, making it look fresh.Upon vacating, the owners complained about the blackened flooring, even though the entire building had the same issue.
Despite explaining this, they refused to listen, leading to arguments.
They deducted ₹30,000 as rent and were supposed to return the remaining ₹70,000 from our security deposit.
However, they only returned ₹30,000 and are now refusing to pay the rest.
When we asked for clarification, they redirected us to the broker, but even the broker has no idea what to do.

April 2, 2025 at 11:00 amYou lived on a rent for 2 yrs….in some places there are unsaid agreements that tenants pay for the paint etc when they are vacating…Check if that’s the case…
I’m not asking you to not take the legal route…just asking you to be better informed.

April 2, 2025 at 4:25 pmTalk with the landlord and ask him what things need to be repaired or restored for you to get the whole deposit back. A condition for getting the entire deposit back is to always return the rented premise in the same condition as you received it. Since that happens very rarely, some amount of deposit usually gets cut as damages.-

April 3, 2025 at 5:35 amUnless you don’t register your rent agreement at the local court, it’s difficult to take any legal course against the land lord.1. You’ve to give a notice period and only then move out, so the land lord deducting rent is sort off okay. You could’ve discussed this before moving out but leave it.
2. You never have to paint or do anything from your own money, you’ve to ask the owner to either deduct it from deposit & just arrange painters to know the exact value.
3. Broker has nothing to do at this point. Only option you’ve is, you can squat at the flat till you get your deposit back which is again unnecessary. Never hand over the keys until all dues are cleared
