March 1, 2025 at 8:16 amI had paid plumber 15K in 3 payments of 5k each via upi. After 3rd payment he says he didn’t receive the 3rd, but I have evidence that I paid. Please advise what legal course of action should I take.More details below –
I had some plumbing work to be done. Plumber said total work would be 15 k round figure and I agreed. I said ill pay in 3 instalments of 5k via upi and then messaged him in whatsapp regarding what we agreed on.
I made the first 2 payments on agreed dates to upi address that he gave, he acknowledged that he received. The UPI address was okaxis so I guess it was googlepay but the name shown was of some completely different person (same Altaf Quadri) and plumber said it was correct. After making the most recent third final payment of 5k, plumber says he didnt receive. I have evidence from my bank statement that payment was done and money debited from my account. I asked him multiple times that day to check his account and he denied receiving everytime. Now he says that the upi he gave was of someone he owed money to in west bengal and not his and that guy (Altaf) says he didnt receive..
Plumber has stopped picking my calls and not answering my whatsapp also now.. I am thinking of approaching the cops regarding this. Please advise what course of action should I take. The work he has done, though satisfactory was incomplete and I had to rush and get another plumber to complete.

March 1, 2025 at 9:44 amBro, the only place you can get a lawyer is by physically approaching one. Here I can claim to be Kapeel Seebal and you would be none the wiser if I am or not-

March 1, 2025 at 9:58 amBro, just asked if he was one. I know you can claim to be Kapil Sibbal or Dr. Ambedkar himself.-

March 1, 2025 at 11:04 amIf he’s harassing you, ask for his bank statement. Keep your bank statement ready and ask for his bank statement for proof. You don’t need a lawyer. Go to the police station, show them your bak statement and tell them this guy is harassing you.

March 2, 2025 at 1:05 amIf he’s not picking calls then what’s the issue? You have the statements, if he brings it up again, then ask him to produce the statement of the recipient or be silent. The onus is not on you to do anything here – you’ve done your part.-

March 2, 2025 at 6:43 amMy issue as mentioned in the post, was that I paid full and he’s left the work incomplete. Why will he bring it up again ?I have all evidences of all payments and all WhatsApp conversations as well as voice recordings of all audio convo.

March 2, 2025 at 9:31 amAh okay. Your real issue was mentioned like an afterthought in the penultimate paragraph – didn’t register it. Yeah, it wouldn’t be worth it to pursue it legally but you may be able to intimidate him into returning the final instalment by filing a complaint (not an FIR) and getting the cops to call on him-

March 1, 2025 at 10:06 amYou dont have to do anything. You have paid, and you have proof. He can go to court and try to prove that he hasn’t received.

March 1, 2025 at 11:19 amWhat a joke of a reply. OP has made complete payment and plumber and his friend have received it. They are just making a fool of him. Now plumber is not taking calls from OP and not finishing his work too. There is no reason for plumber or his friend to go to court.-

March 1, 2025 at 8:51 amDo nothing. If you have all the info let them take legal action and simply show the police that you paid. -

March 1, 2025 at 9:28 amThere is a possibility that before your 3rd payment, he must’ve changed his primary account by mistake by either switching to a new phone accidentally and maybe the amount you sent got credited to a different bank account of his…-
UUser_45de8244
OP
March 1, 2025 at 10:01 amIndeed, possibility can be anything including that both plumber and / or that Altaf fellow are lying. but what legal action can I take now is the question.-

March 1, 2025 at 10:16 amSorry I’m NAL. But 99.69% I’m sure no government related service can help you. You have to take things into your own hands. That’s a small amount of money so I’m pretty sure no lawyer would also be interested in helping you. All you can do is just keep asking the plumber to share his statement or ask him to show you his phone/gpay account or any upi account to show your messages and transactions to make him understand. Since it’s all digital you’re safe even if things escalate.

March 1, 2025 at 11:16 amboth are making fool of you, Next time do not make payment to a third party. Should have paid the plumber and let him trf to who ever he wants to and also never pay in full till work completes to your satisfaction.-

March 1, 2025 at 3:10 pmWell if they arent answereing your calls then why bother, let them come after you and if cops come you show the statement thats it, even if court you have a solid proof right and what exactly are you going go complain? -

March 1, 2025 at 4:20 pmNAL,.but not sure what your concern is? You have paid and you have statement to prove. The only way he can catch you ( legally ) saying that he didn’t asked you to pay Altaf. I guess you have proof of interaction that he had indeed requested you to pay Altaf.
Let him take legal course ( if he thinks he will do that for 5K ).Similar way, you can take legal action (civil route) only. This is not a criminal case IMO. But are you willing to go that route for few thousand rupees?
Your work is done and just forget. That’s the only logical step I can think of.

March 1, 2025 at 5:38 pmMaybe I wasn’t clear in my post but I paid full, and as mentioned in the very last line – plumber didn’t complete the work. BAs per him he didn’t receive the final 5k. Rather the person who’s upi address he had given to me told him (the plumber) that he didn’t receive the final 5k and plumber refused to complete till he received the final 5k. I had to get hold of another plumber and pay him extra to get the work done.

March 1, 2025 at 5:17 pmCheck the other person’s bank statement. Cz in my case i paid someone and it failed and money was debited from my account. Then the other person said that he received the payment. It has been 3-4 months now, still the status showing failed. As the transaction failed it should be refunded within 72 hours but nothing happened. I complained about it to my bank also Paytm but no solution. As my bank is virtual bank(jio) no satisfactory response. -

March 1, 2025 at 8:57 pmNALI suggest couple of options.
1. Plumber seems like a noob scammer. Scare him off by sending a legal notice on WhatsApp. Ask for 5+10k return for failing to provide services and causing mental harassment. Mention what he’s done is cheating and you may file criminal FIR. Give one week’s time to respond. Use ChatGPT to draft one.
2. Register cyber crime complaint on the disputed payment. That Altaf guy’s account will be frozen. Let him go after plumber’s a**.
