May 3, 2025 at 3:26 amIncident: My car was parked in front of our shop, lawfully having enough space for two vehicles to pass through (one lane road).A mini truck came in, trying to park infront of my car, but due to the negligence of the driver, hit the right side fender, the bumper and the headlight of my car, these are now completely destroyed and has to be replaced. (Incident is caught on cctv clearly, multiple incident photos and videos, including multiple eyewitnesses)
The estimated repair costs are around 50k, of which around 10-15k will have to be paid by us, as the insurance is not bumper to bumper.
The driver of the vehicle which caused the accident says he has no money and can’t pay. The owner says he won’t pay, and that you (us) can file a case.
Now what are my options,
1. Can I file a MACT case after claiming the insurance, for the balance amount of repair amount payable from our hand, and loss of use, loss of no claim, rental car charges, legal costs?2. Normal civil court case for property damage?
3. What is the best route for maximizing our compensation, and quickest and hassle free(comparatively)?

2) When the owner said he wouldn’t pay, sieze rhe vehicle and sell it. Take your expenses and rest return to the driver for his settlement.This is unfortunate to resort to these tactics, but that’s how i see things being done fast.

May 3, 2025 at 4:21 amLawyer here. Cant file an MACT claim but you could definitely go with a civil suit. Try getting a good legal notice sent first since half of the times, a legal notice does the trick.-

May 3, 2025 at 6:03 amDo you actually own the space in front of your shop where your car is parked, or are you just another one of those people who claim public property—roads, footpaths, anything in front of their place—as their own? Illegally adding ramps, parking wherever they like, acting entitled. If that’s the case, then honestly, I have zero sympathy for whatever happened to your car.
