Asking for a close friend. Father has left the child and spouse and is not supportive. Not officially separated. Mother applied for passport for her 2 year old child. She also attached annexture C. But the passport office gave appointment for RTO office 2 months later. Annexture C says that mother is responsible for any legal case by father and not passport office which she is ok with.

What extra preparation to do for appointment in RTO office? Can we do legal case against passport office if they refuse still, considering we have all documents?
Any specific questions to keep in mind?

Any idea why passport office create so much hindrances for single mother considering all desired documents are provided with only reason that they fear the father? Can we complain anywhere?

        Thanks in advance.

The fact is that Annexure C is not applicable if there is no judicial separation. The father must have at least refused permission in some written communication. The RPO will not be satisfied with a bland statement “we’re unofficially separated”.

I see. Interesting. That means rules means nothing and in the end what RTO decides takes precedence.

That’s not true. The conditions for Annexure C clearly law down the proofs to be presented. If no proof is unavailable then it’s at the discretion of the RPO to ask for other proof or deny the request.
