        Background

        My sister borrowed money from someone approximately 10 years ago. She no longer lives with my parents. My parents (aged 68 and 69) live alone in Kerala.

        What happened

        In December 2025 this person called me directly and threatened to put up posters of our family in front of our house. I have this voice recording saved.

        In April 2026 he came uninvited to my parents’ home asking for my sister’s whereabouts (he has been doing this for a while). My father got angry and made a gesture toward him but no physical contact happened. The person recorded this on his phone and is now threatening us not just about video, he comes and abuses my parents.

        My concerns

        • My parents are elderly and cannot handle prolonged court cases

        • I am not currently in Kerala

        • We don’t know if my sister has other debts and want permanent protection for my parents

        What I have

        • Voice recording of December 2025 threats

        • Dates and details of both incidents documented

        My questions

        1. Does our family have any legal liability for my sister’s debt?

        2. Can I file a complaint against him for criminal intimidation ?

        3. Is the debt legally time barred after 10 years?

        5. Would a legal notice to him protect my parents from him and any future creditors?

        6. any other solutions

          Your family is not legally liable for your sister’s debt. What the loan shark was doing is standard among loan sharks where they visit the house / office, then file a complaint saying they were harassed and assaulted by the people in that house when they went to recover a loan.

          Don’t worry about it too much. Advise your parents to be patient and not let people in their houses again, and install cameras so they can record forceful entry into their property.

          If the loan collector is from a bank, send a legal notice to the bank. If he’s from an nbfc, do the same. If he’s the local loan shark, send a notice directly and file a police complaint. I’m not well versed with Kerala’s state laws but I believe they do have an act regarding these independent loan providers and how much interest they can charge and what they should and shouldn’t do. Proceed forward with a lawyer in accordance with those laws.

          The quickest way to resolve this however, would be for your sister to repay the said loan.
