February 12, 2025 at 1:33 pmβI have been allotted a PG seat in a private medical college in south. We havenβt officially joined yet, but we have come to know that the college has not been providing stipends to PG residents for years, despite NMC regulations mandating it.When the issue was raised, the administration stated that since the hospital is run under a trust and provides free treatment to patients, they are not obligated to pay stipends. However, this does not justify denying stipends to residents, especially when the college charges high tuition fees.
I would like to know:
1. Are there any legal provisions that make stipend payment mandatory for all PG residents, regardless of hospital type (private/trust/government)?2. Has there been any precedent where PG residents successfully fought for their stipends?
3. Would it be better to take legal action now before joining, or after starting residency?
4. Should we approach NMC, the state medical council, or take legal action directly?
Any guidance on how to proceed while maintaining anonymity would be greatly appreciated.β

February 13, 2025 at 12:58 pmI think the cases are pending. WP(C) 730/2022 and other connected cases are still under consideration of supreme court. The court had directed the nmc to collect data on payment of stipend to medical pg students. That’s what I remember-
