There is a huge background to this case but I’ll try to be as short as possible
My father comes from an upper middle class background, my mother on the other hand was raised by single mother, poor background.
Their marriage started off good, but soon enough problems emerged. My father is a womaniser, who changed for my mother.
        They never change.
In 2010, he had an affair, by 2012, he wanted to leave my mother. Domestic violence became everyday thing. She was emotionally, verbally, physically and financially abused. He was the sole earner, and he fled from his home leaving 2 kids, aged 11 and 15 with no money.
My 11 year old self was worried how will we eat food. That’s when my mother decided to go to court. She filed for a case. She was tortured, treated poorly by our honourable courts, with judges saying things like, β€œhe (my father) is a man and may like to go out with multiple women”. My mother was harassed by domestic violence cells. She fought bravely for years. We though stayed under the same roof.

We were finally given a monthly maintenance. Money was stable for sometime but he continued to harass mentally. The future seemed completely doomed.

Soon enough he stopped paying money again. We had to file a case again to get the payments. The harassment kept on increasing. Finally came a point where a lawyer suggested to put a case and leave the home.

We packed our stuff and shifted on rent. This did stop the mental harassment but my father completely stopped paying anything. When we had no option but to go with a new lawyer, she told us that the previous lawyer had misguided to us the worst extents. The case is all jumbled and she helped us revive an older case. I am 25 and my brother is almost 30

We do not have even 1/6th of what is required to buy a home and marriage seems far fetched. My mother is unable to live with the thought that how this is ruining our lives forever.

The new lawyer though is better, but in every hearing their lawyer tries to delay the hearing by saying that papers are incomplete or the file is missing or the process is wrong. She never emphasis on how it is difficult for us to even meet ends, how tough it is to pay rent and carry our daily work, owning a home and marriage seems to be a very far dream.

We are completely hopeless at the moment. We were supposed to have arguments today but his lawyer raised an objection of how our papers were till the end of financial year and not till august, the month in which affidavit was submitted. We are given 4 month old date. This is insane. Please share any guidance.

Hi, lawyer here, unfortunately our courts are known for their lengthy dates and due process methods

Nothing you can do but stay strong and persevere, keep faith

If your lawyer is good enough, you will get out of this

Yes, I have seen dates granted for even more ridiculous reasons

Urgent matters are given fast dates, but they are very rare
