Police asking for address and aadhar card

My friend is falsely accused in a FIR filed for vendetta.

The police sent him a WhatsApp notice under BNSS 35. We know that according to recent supreme court judgement, electronic notice is not valid.

Now the police are calling him to ask for his address and aadhar card. They only have his phone number and city.

Should we give them this information?

No. Ask your friend to lawyer up and see what the charges are etc.

We consulted 2 different lawyers.

1 said you should co-operate with them so they can send you the notice. If you don’t co-operate, they find it more suspicious.

Another said, don’t share any information, don’t pick their calls.

The police called after sending WhatsApp notice and asked to come for inquiry.

If he goes there unprepared he’ll be detained or arrested. Get a lawyer to accompany and get a copy of FIR.

This is weird problem in India. I too faced similar 2 views from different set of lawyers. I feel practical approach based experienced lawyers will ask you to avoid contacting them basically to buy time. The strict text book lawyers will tell you to reply to the notice or contact them. Both are correct. Depends on your case or what or how you intend to tackle the case.

How did you conclude the practically experienced one will say to avoid the police? Shouldn’t the one who follows textbook approach cite the recent judgement of SC and tell their client to not contact the police without getting a notice?

Electronic notices aren’t valid,
unless the FIR is serious, it can be ignored better yet leave it unseen.

Hire a lawyer, get an anticipatory bail ready & co-operate with police if the complaint is legitimate. If you are suspicious, just ignore it as scammers are all around scamming people with fake police FIRs

Yes. We have a copy of the FIR. The accusations are against someone else but his name is mentioned as a potential known person of the accused.

Lawyer up and join the inquiry. If opposite party is big/capable then lawyer can be asked to find anticipatory bail before joining inquiry.

Ignoring won’t help if FIR has been lodged

Buy yourself a new phone number and close it for three months. If anything bad is supposed to happen, it will happen regardless of your cooperation.

If I were you, will ignore and respond asking them to share details of alleged violation/s immediately.

Maybe a legal looking response should be sufficient.

If police wanta they will still get your aadhar and address without your cooperation.

So better to cooperate if your friend is named in FIR, take a lawyer with you to be safe.
