        Hey everyone,

        I need some advice on a frustrating situation. A few weeks back, my house was robbed and we filed an FIR regarding the incident, which involved a loss of 10 lakhs. Since then, there’s been no progress on the case. Today,, I requested a copy of the FIR, but the police are unable to locate it—not in their physical files nor in the central database. They even claim it’s in the database, which I know isn’t true.

        To make matters worse, the Station Inspector is now asking me to file a fresh FIR copy. I can’t understand why I should have to do that when the original was already filed, and it seems like this bureaucratic mishap is the reason we haven’t seen any progress in recovering our losses.

        Has anyone experienced something similar or have any suggestions on how to proceed? Should I insist on a proper investigation, escalate the matter, or is there another legal recourse I can take? Any advice or shared experiences would be really helpful.

          File RTI and ask whether it has been lost and if yes then how. FIR cannot be lost it it was filed. It is kept in CCTNS database. See what they reply in RTI.

              Do this and then file a Writ Petition.
              This is so unfortunate. If not an FIR, they should be able to show you a daily diary entry. If there’s nothing, they sat on your complaint and buried it.

                  Most likely they didn’t file it and just told you that it was filed.

                Did you check their complaint notebook which they maintain in their police station?

                    Are you sure FIR was filed and not a DDR ? FIR can be downloaded online from the state police website as well if you know the date of FIR.

                        Bring this into the knowledge of CP. If it falls to deaf ears, go before the high court in writ jurisdiction seeking proper investigation and appropriate relief.

                                Yes, I recently had a chance to file a similar writ before the Bombay high court wherein certain evidence was “misplaced” by the police authority and based on lack of evidence “a-summary” came to be filed. Though the IO was changed and transferred, but the offence required the investigation to be conducted afresh due to change in evidence.

                              Btw, do you have the stamped receiving copy when you filed the complaint? There must be a diary number.

                                  Actually they just took the complaint and my sign. I was asked to write what we had lost, the amount and everything. That’s it. I have that copy.

                                  Go to the Police Commissioner office to complain and watch the FIR Copy appear magically. If the Station in-charge tries to intimidate you afterwards then bluff him by saying you will use even bigger contacts this time if he does not stop. That shuts them up pretty quick, personally tested.

                                    FIR won’t be lost simply…one copy is sent to court. And the same has to be uploaded on website… Ask them who was the IO as he also gets a copy.
                                    And more things are there…. It seems that that the FIR was not filed in first place

                                      FIR was never filed it seems. Maybe a GD instead.
