May 5, 2025 at 4:20 amOur society is in Mulund and is three years old. The society got formed without the support of developer. We have a policitally influencial person in society who owned the land before the building got constructed. Now this person owns 6 flats in the society but has not paid a single rupee towards the monthly outgoings. He has given all the flats on rent as well. When the society ask for payment, he sends his buddies from municipal corporation to harass the society over trivial issues like someone installing grill, non payment of some random bill etc. People are scared of this person.What is the legal way to make him clear his dues without society getting involved?

May 5, 2025 at 4:47 amYes, I am a lawyer. It’s rightful to remove connection and block services if the person is defaulter for years as in OP’s case. Just serve him notices threatening blocking services and if he fails to comply you should proceed.Non-payment of society due for years, doesn’t entitle you for the services for lifetime. Use your common sense as well.

Iβm not a lawyer, and yet I could see how your first advice was lacking the most important part: serving legal notice first. I’ve seen cases where people cut electricity and water connections of illegal tenants and the courts asked the landlord to resume it as itβs basic human right. At least give complete information if you wanna give it. Youβre a lawyer man?-

May 5, 2025 at 1:31 pmIt’s different in every state. In many states, the maintenance fee is not taken separately from tenants and is included in the rent, which is paid directly to the owner of the flat. The owner is liable to pay the maintenance.

May 5, 2025 at 3:05 pmAs an aside to this – i think society NOC is required for leave and license agreements. Not a lawyer so don’t know about the law in this regard. But society can withhold the NOC required in those cases if possible
