March 21, 2025 at 9:58 amI bought a empty land in my home town bit far from where I live currently, then converted it into godown and rented it to a tenant around 2020. The tenant’s business was not going well after some time and it is completely not functional for more than a year now. No rents for more than a year now. They are refusing to move out and using our space like a storage. Looks like the tenant had borrowed money from a politician for business and couldn’t repay. The politician now wants to take over the business and run.He wants to buy from us for 30% below current market value and has been not allowing us to sell or vacate the property. After talking to some of my contacts we have two options
1) File a case against tenant for not paying rent and to vacate. It seems it will take anywhere between 3 to 10 years from what I am hearing. Problem with filing case is, my father may have to attend these court cases as I live far away from my home town and occasionally I also may need to travel. Also it adds more stress.
2) Accept the low offer.I am thinking to just accept the low offer just for peace of mind, but at them same time felling very angry for losing my hard earned money. Please suggest if there is a better way to handle this situation and which option would be better.

March 21, 2025 at 10:32 amYes you’re right. Practically speaking, fighting a case with politicians involved is like putting your face in a can of worms.
Be nice to the politician, haggle a bit, try for 15-20% lower and sell it asap.
Let the politician handle the tenant in his own way. -

March 21, 2025 at 10:42 amDoes the politician belong to the ruling party? Does he hold any office? Or does he belong to the party of the local MLA?
If there’s a strong opposition, reach out to them. I’m pretty sure they’ll be interested in helping you out.
Either way, tell him to increase the price offered. If he listens then well and good or else you can go about the former.-

March 21, 2025 at 10:52 amTrue. Tho Iโd suggest taking this to Twitter but then, local politicians are worse than criminals. Itโs better to just not. Keep peace and move on with whatever money you are getting or haggle a bit and agree mutually.

Your father will not need to attend every hearingโhis presence will only be required during the evidence stage, while the advocate can handle the case alone on rest of the dates.Legally, a tenant must pay rent to contest an eviction suit. If they have defaulted, they lose the right to oppose the eviction. This ensures you receive rent for the entire duration of the suit, which may take a few years. However, once the matter is in court, the politician is unlikely to take any coercive action.
Meanwhile, try to convince the politician to purchase the property at its full market value. If he attempts to pressure or intimidate you, consider raising the issue on social media.

A civil suit is going to take its toll on him and distract him.While your advice is on point, the tenant may resort to a number of mischievous tricks to avoid paying the rent while the suit is pending.

Sorry OP i can’t answer this question as I feel very frustrated as a fellow indian with people living with jingoism and what not and I don’t have a good answer…. -

March 21, 2025 at 11:43 pmIf you have not placed a rental agreement and registered ,then it is a bit problematic. I would suggest you to cut off the water, electricity supply and employ other tactics(nothing illegal). If you are not in need of money , just wait . The situation will change. Try to sell off the land to a bigger player, someone who has the power and the time to handle such situations.
