Power Company built tower on land. What are my options?

I bought about 7 acrs of land in TN about 7 yrs ago. Have not visited in 3 yrs. I visited last week and saw huge transmission tower on my land.

Its in a corner of the land. Occupies about 120ft* 100ft.

I visited local EB office and they have no clue.

I am happy to sell the land to Govt. Or lease it them.

What are my legal options?

Typically, government pays the land owner while they are setting up the tower. You also have to be cognizant of the impact the radiation and electric field will have on the usability of the land.

You will need to find out the all details from the municipal corporation, power company involved & electricity board by filing RTI Application.

Legal remedies :-

1. Civil Suit seeking compensation for illegal occupation of land and a mandatory injunction for removal of the structure.

2. If the government or power company has acquired your land (or part of the land) without following the legal procedure and giving fair compensation, you can demand compensation under Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

3. If RTI reveals that some approvals etc. were granted illegally then you can challenge it in a Writ Petition.

4. You can also file police case for trespassing, though I doubt this will work.

Contact the transmission company, they’ll compensate you.
