January 18, 2025 at 4:08 amIf an interfaith couple is married under both SMA and then a nikkah is performed, which laws would apply to our marriage? Would our marriage follow Islamic laws or constitutional laws? We plan on doing the SMA first. -

January 18, 2025 at 12:31 pmSome islamic scholars say that nikkah is permissable with non-muslims as long as they believe in the prophets who came before. Not with kafirs though.So that means christians and jews are allowed. Those that follow old testament mainly. They believe in the prophets even if the names are slightly changed (Musa(AS)=Moses, Isa= Jesus,Nu(AS)=Noah)
NOW, who is a kafir? The non-believers. i.e hindus, sikhs, buddhists etc.
Now, please dont argue with me. I’m only sharing knowledge. And if I’m not mistaken, i first heard this from Sheikh Assim Al Hakeem. If anyone finds the clip, please link it.

Personal laws cannot supersede SMA if the marriage is solemnized under SMA.For those confused as to how nikkah can be performed to a non islamic woman, in Islam those who are kitabiya, that is followers of the abrahamic faith, can validly marry muslims under islamic law. A marriage of a non-kitabiya is only irregular but not invalid. So a nikkah ceremony can be performed and a nikahnama can be created.
