My [M,31] grandfather died a few months back and we (my parents, my sister and I) are currently staying in our house owned by him.

After his death, the house was asked to be sold off and divided among my father and his two brothers in a mutually agreed ratio.

We agreed to it and signed an agreement for the same. However, we suspect that there was a binding will made by my grandfather which may have been in favour of my father, and no one brought his will forward after his death.

The reason behind such action could be that my father has lived separately throughout his life and they might have conspired against him.

If we obtain the will, and if it turns out in our favour, what possible steps we can take?

You can get the contract vitiated on grounds of fraud because the will was concealed

Can you help me with the procedure of obtaining the will? I have a basic idea but I would like some clarity. If you don’t mind helping

Do you know if the will even actually exists or not?

We are not 100% sure. But since he always mentioned about a will, and he used to be very specific about these things. We are assuming there is one, and it is being concealed from us by the extended family.

That’s like finding a needle in a haystack (if it’s registered) otherwise it’s near impossible

Yeah, if it’s registered, that is the only chance. Else this agreement will determine that we are not on the losing side.

Pay some people at the local sub registrars office where it might have been registered. Open the record of registrations and go through every individual entry for the time you suspect it to have been registered in. Time and labour intensive.
