        We have a property which was jointly purchsed with older uncle. This property was under civil case as the tenant was refusing to vacate the property(empty land) which he held even before our purchase. Court order was ruled in favour of us in july 2924 and we took possession in Jan 2025. In front of my older uncle’s property, younger uncle’s property is present. Which was also under same dispute.

        Both uncles signed an MOU for sharing a passage among themselves.Now older uncle, instead of claiming a passage from my younger uncle he is claing he was accessing his property through our property and has sent us a notice to stop any construction in that part of our land, else legal proceeding will be undertaken. Where as in contrary, he was accessing through his brothers property and we have proof for that.
        We have the original MOU singed and notarised with us. Kindly advice how shall we proceed. Also patta for this land is in my mothers name.
        It is nowhere mentioned as passage in any of our sale deeds.

          Get a lawyer buddy.

          This won’t go down easy. And free advice won’t help a lot here to be honest. There is a lot of nuance to understanding the present situation

              Yeah will do that, want to if the MOU signed between my uncles be considered as valid proof in court.

              Hire a good lawyer and get reply drafted to that notice..

                          Okay, Im just curious to know if MOU is accepted as valid proof in court

                              If it is signed by both parties and notarized, it is acceptable proof of an agreement between parties.
