UMy friend ordered a **letter/card** for me from an online gift store. The order was placed under their name, but the **courier was sent to my address and under my name as the recipient**.
My parents received the package via a delivery service. However, upon inspecting the package, we noticed that it contained a **Himalayan herb with effects similar to Viagra** instead of the expected letter/card. There is a **tiny hole in the package’s outer cover**, through which I was able to see the contents inside. I have **not opened or torn the package myself**.
The **order number on the package matches exactly** with the order number shown on my friend’s account. Moreover, the **OTP for receiving the package was also sent to my friend’s phone number**, confirming that this was indeed supposed to be the original order. This indicates **carelessness on the part of either the seller or the courier company**.
This incident has caused me **immense mental distress**. I would never order something like that, and neither would my friend. To make matters worse, **my parents also saw the contents of the package through the hole**, leading to an extremely **stressful and embarrassing situation** for me.
I want to understand what legal actions can be taken:
1. **Can I demand compensation** from the company for the emotional distress and embarrassment caused?
2. **Should I file a consumer complaint** for misleading/damaged delivery?
3. **Can I hold the company liable for defamation or negligence** since the package falsely associates me with such a product?
4. **Is there any action I can take against the courier company** if they mishandled the package?Would appreciate any legal insights or guidance on how to proceed.

CIg you can file a case in consumer court, or personally explain the situation to the company the product has been ordered from

VHere’s a thought: maybe instead of whining about “immense mental distress,” you should consider trying it out and seeing if it actually works. Who knows? Might be a blessing in disguise for your future endeavors.

UIndia is not the states bud…here you cant whine about things and sue the company for any monetary compensation

MWait I’m guessing you got shilajit? And you’re making such a big deal out of it? Return the product. As simple as that.
Did you even try to return it? There is recourse available in case of a wrong product being delivered.
There is no defamation or emotional distress.
Yes you can take action against the company by returning the product for a replacement / refund. -

UThey can give you the money back for the original letter and stuff but nothing more I doubt you would even win the case even if you filed the the loss of your status wasn’t large scale or even amongst a lot of people your family which already makes your case weak and then the delivery guy who see this stuff anyways because people order a lot of this stuff so no you ain’t gonna get no compensation 😂
